Conflict avoidance and resolution have always been primary purposes of the law. Satisfaction with judicial processes has declined in many jurisdictions. After the diversion of many disputes from courts to arbitral tribunals, arbitration has now also become a target of intense criticism.This dissatisfaction with binding third party adjudication of disputes coincides with rising tensions among citizens asking basic questions about what they can expect from each other and their governments in a constantly changing world. One response has been the proliferation of processes between disputing parties that are structured and interactive negotiation and assisted by a neutral third party using specialized negotiation and communication techniques. These processes have been labelled “mediation”. While mediation is not focused on the identification and application of legal rights and duties in the way that adjudication is, its success remains dependent on a legal framework which is still evolving in most jurisdictions and especially across borders. In this edition of the Comparative Law Yearbook of International Business, lawyers from nine jurisdictions examine developments relating not only to the framework for cross-border mediation, such as the Singapore Convention or inter-State disputes, or relating to their countries’ overall approaches to regulating this method of dispute resolution, but also relating to specific issues, such as mediator ethics and conflicts of interest, and even exploring the neural science of conflict dynamics.

Untersucht werden exemplarisch die Entwicklung des Mediationsrechts in Kroatien und Serbien. Goldmann analysiert mithilfe eines Rechtsvergleichs und qualitativer Experteninterviews den Einfluss der internationalen Rechtsstaatsförderer, die Modellgesetze und EU-Mediationsrecht in nationales Recht importieren. Die unterschiedlichen Ergebnisse in Kroatien und Serbien zeigen, dass der Import von Mediationsrecht dann als erfolgreich gewertet wird, wenn parallel das bereits bestehende Mediationssystem des Landes gefördert wurde. Die reine Förderung der Mediationsgesetzgebung hingegen, führt zu einer Verrechtlichung des Mediationsverfahrens, die sogar eine Stagnation der Anwendung von Mediation zur Folge hat. Daraus werden praktische Schlüsse für die zukünftige Förderung von Mediationsrecht in Übergangsstaaten gezogen, was insbesondere für Länder von Interesse ist, die, wie etwa die Ukraine, vor der Einführung von Mediationsgesetzen stehen.

Whether in science or in international politics, neutrality has sometimes been promoted, not only as a viable political alternative but as a lofty ideal – in politics by nations proclaiming their peacefulness, in science as an underpinning of epistemology, in journalism and other intellectual pursuits as a foundation of a professional ethos. Time and again scientists and other intellectuals have claimed their endeavors to be neutral, elevated above the world of partisan conflict and power politics. This volume studies the resonances between neutrality in science and culture and neutrality in politics. By analyzing the activities of scientists, intellectuals, and politicians (sometimes overlapping categories) of mostly neutral nations in the First World War and after, it traces how an ideology of neutralism was developed that soon was embraced by international organizations. This book explores how the notion of neutrality has been used and how a neutralist discourse developed in history. None of the contributions take claims of neutrality at face value – some even show how they were made to advance partisan interests. The concept was typically clustered with notions, such as peace, internationalism, objectivity, rationality, and civilization. But its meaning was changeable – varying with professional, ideological, or national context. Each country analysis applies the book’s overarching principle of a specially designed Regulatory Robustness Rating System, which is thoroughly explained in an introductory chapter.
