Studienarbeit aus dem Jahr 2014 im Fachbereich Soziologie - Politik, Majoritäten, Minoritäten, Note: 1,0, Christian-Albrechts-Universität Kiel (Wirtschafts- und Sozialwissenschaftliche Fakultät, Fach Politikwissenschaften), Veranstaltung: Menschenrechte – ihre Begründung und Bedeutung, Sprache: Deutsch, Abstract: In der folgenden Arbeit wird der Frage nach dem normativen Geltungsgrund der Menschenrechte nachgegangen. Wodurch können Menschenrechte normativ letztbegründet werden? Inwieweit lassen sich aus dieser normativen Letztbegründung tatsächlich Menschenrechte nach heutigem Verständnis ableiten? Welche Kritik kann an der Wahrheitsfähigkeit der Begründungsansätze, sowie an deren Potenzial, Menschenrechte nach unserem heutigen Verständnis zu begründen, angeführt werden? Im Einklang mit einschlägiger Literatur soll sich bei der Beantwortung der Ausgangsfragen auf eine religiöse, eine deontologische sowie eine konsequenzialistische Herleitung konzentriert werden. Das Spektrum umfasst somit eine theologische Begründung sowie die wesentlichen Zweige der, sich von metaphysisch Vorannahmen weitgehend zu emanzipieren versuchenden, kognitivistischen Ethik. Menschenrechte sind heute eine der großen globalen Integrationsformeln, auf Basis derer normative Legitimität für Meinungen und politische Vorhaben reklamiert werden kann. Der Wortbedeutung nach bezeichnen diese eine Gruppe von Rechten mit dem Anspruch, jedem Menschen, allein auf Grundlage der Zugehörigkeit zur menschlichen Spezies, zuzustehen. Mit den Menschenrechten wird heute ein universeller Wahrheitsanspruch verbunden, das heißt, dass diese unabhängig von der subjektiven Lebenswelt und dem hiermit verbundenen kulturellen Sozialisationsrahmen des Adressaten normative Geltung beanspruchen. Es kann nun die Frage aufgeworfen werden, worin diese besonderen Rechte des Menschen begründet sind. So wurde kritisiert, dass allein die Zugehörigkeit zu einer bestimmen biologischen Gattung kein ausreichender Grund für die Zuschreibung partikularer Rechten ist. Eine rein rechtspositivistische Begründung scheint ebenfalls zunächst ungenügend. Trotz der Relevanz einer solch empirischen Perspektive scheint es lohnend, theoretisch nach einer normativen Letztbegründung der Menschenrechte zu fragen – auch, da derartige Ideen einen bedeutenden Einfluss im Prozess der sukzessiven Sakralisierung der Person hatten und für die diskursive Durchsetzung dieser Idee bis heute aktuell sind.

The complex legal situations arising from the coexistence of international law, state law, and social and religious norms in different parts of the world often include scenarios of conflict between them. These conflicting norms issued from different categories of ‘laws’ result in difficulties in describing, identifying and analysing human rights in plural environments. This volume studies how normative conflicts unfold when trapped in the aspirations of human rights and their local realizations. It reflects on how such tensions can be eased, while observing how and why they occur. The authors examine how obedience or resistance to the official law is generated through the interaction of a multiplicity of conflicting norms, interpretations and practices. Emphasis is placed on the actors involved in raising or decreasing the tension surrounding the conflict and the implications that the conflict carries, whether resolved or not, in conditions of asymmetric power movements. It is argued that legal responsiveness to state law depends on how people with different identities deal with it, narrate it and build expectations from it, bearing in mind that normative pluralism may also operate as an instrument towards the exclusion of certain communities from the public sphere. The chapters look particularly to expose the dialogue between parallel normative spheres in order for law to become more effective, while investigating the types of socio-legal variables that affect the functioning of law, leading to conflicts between rights, values and entire cultural frames.
