This book addresses one of the most serious societal questions of our time: how to create new spaces and frameworks for minority recognition given the State-centric sovereignty discourse and the persisting equality jargon that dominate today's world. By so doing it approaches minority rights by means of a critical engagement with its underlying premises. Notably, it makes attempts to both construct and reconfigure neglected legal categories, in particular collective rights, and to deconstruct domestic constitutional orders. More precisely, it does so through diametrically opposed levels of analysis, that is top-down and bottom-up logics, by exploring sociolegal strategies, forms and formats of governance on the one hand, and grassroots demands on the other. Drawing on empirical findings in Europe and Latin America, the book gives us a sense of how recognition needs to be contextualised against the background of right-wing trends in Europe and the re-building of the State in the Andes. This book develops a critique of the equality paradigms and principles to be found in the majority of today’s legal orders. Este libro es una buena muestra del debate en torno a la crisis de la democracia en el debate público. Refleja con claridad la diversidad de manifestaciones que se están produciendo en el espacio público y en la comunicación pública, que indican una clara percepción de crisis por parte de muchos actores que concurren tanto en la conversación pública como en la opinión pública: crisis en clave de transformación, pero en otros casos crisis en términos de deterioro de las condiciones democráticas. Si bien el contenido es muy plural, confluye en mostrar una enorme inquietud. Por un lado, las transformaciones que están viviendo las arquitecturas y el desarrollo de las democracias liberales debido al desarrollo científico-tecnológico y a la apertura de nuevos espacios de relación social, económica y política a nivel global están provocando cambios en las formas y en los contenidos de los estados democráticos. Por otro lado, inquieta la crisis de rendimiento que se observa en las democracias avanzadas; una crisis de rendimiento que se observa en las notables dificultades que atraviesan los estados para mantener el estado del bienestar y el incremento de las desigualdades y también en la respuesta de la ciudadanía, que muestra una desafección cada vez mayor respecto al funcionamiento de la democracia, si bien no tanto respecto a la idea de la democracia.La emergencia del populismo es el mejor botón de muestra de la crisis de las democracias liberales, que viven hoy un importante reto en orden a redefinir un nuevo contrato social en el que se establezca cuál es el papel de las estructuras públicas y cuál es el papel de la ciudadanía y de la sociedad organizada en la articulación de ese espacio común. Esta será una de las grandes tareas que tienen por delante las democracias liberales y tendrá que ser abordada en el contexto de una nueva agenda social provocada por el actual modelo de desarrollo, que está teniendo consecuencias críticas; todo ello va a estar vinculado al logro de una cierta estabilidad en el ámbito internacional.Los capítulos de este libro son una buena radiografía de los debates que se están produciendo en el espacio público sobre las condiciones de transformación de la democracia y sobre el descontento que está generando su funcionamiento.
