Apparso nel 1955, La filosofia dei giuristi italiani consolidò definitivamente il posto di Luigi Caiani nella cultura giuridica italiana di metà Novecento. Pur ancora relativamente giovane, con questo libro Caiani si poneva infatti come un interlocutore critico, e scevro da ogni timore reverenziale, dei più autorevoli esponenti della cultura giuridica italiana del tempo, da Tullio Ascarelli a Francesco Carnelutti, da Emilio Betti a Piero Calamandrei, da Salvatore Satta a Giuseppe Capograssi. Di questi giuristi, che avevano profondamente innovato gli studi giuridici italiani anche grazie alla loro apertura a saperi metagiuridici (come l’economia, la sociologia, e, soprattutto, la filosofia), Caiani indagava e discuteva per l’appunto i presupposti filosofici, la “loro” filosofia: una filosofia che emergeva non tanto dalla partecipazione di quei giuristi a riflessioni e dibattiti di taglio astrattamente speculativo – ché questo era, allora, il modo precipuo di intendere la filosofia – ma dal modo in cui trattavano problemi specificamente giuridici. Una filosofia dei giuristi, dunque, che Caiani ricostruisce in maniera magistrale, e senza risparmiare di segnalarne gli aspetti non sempre lineari e le implicazioni non sempre chiaramente colte dai protagonisti stessi di questa vicenda culturale.
