A identidade do transgênero surge da transgressão de uma matriz pré-cultural binária e heteronormativa. Na performance deste gênero, frequentemente, expõe-se à opressão e vulnerabilidade, que são confirmadas, em âmbito nacional e internacional, por pesquisas da sociedade civil e da Organização das Nações Unidas (ONU). Embora a urgência e relevância do tema, é tímida a atitude defensiva do Estado brasileiro, mercado e da sociedade civil. A ONU, nos 17 Objetivos do Desenvolvimento Sustentável (ODS, Agenda 2030), estabeleceu alcançar a igualdade de gênero (quinto objetivo), mas deixou de incluir o termo transgênero ou referências à comunidade LGBTQIA+. Apesar de significar avanços na luta pela igualdade entre gêneros binários, perdeu-se a oportunidade de dar visibilidade e obter compromissos de inclusão explícita de direitos dos transgêneros. O Brasil, Estado de Direito Democrático, deve respeitar a ordem jurídica interna e internacional, especialmente de direitos humanos, sem discriminação (Art. 4o, II CF/88), contudo, esta pesquisa aponta pouca atuação para tutelar e promover transgêneros. As conquistas alcançadas foram, especialmente, por força de decisões judiciais. Em análise das competências do Estado brasileiro diante do domínio econômico, identifica-se a importância da intervenção (Art. 174 CF/88) para promover inclusão socioeconômica dessas pessoas. Indica-se, fundado nas normas promocionais (Norberto Bobbio), a oferta de certificação pública, "Selo TransFormador", para estimular oportunidades de acesso e permanência nos negócios jurídicos, seja relação de emprego ou trabalho, notadamente em empreendimentos transgêneros. São condutas de responsabilidade social diante da realidade vulnerável. Da análise de avaliadores de responsabilidade social empresarial – nacional (Instituto Ethos) e internacional (ISO) – sugere-se aperfeiçoar parâmetros objetivos desses marcadores a compor um futuro cadastro público para orientar empresas interessadas no selo. Será mais uma oportunidade de transparência às relações de consumo e de alerta aos consumidores conscientes e combativos. Esta pesquisa, bibliográfica e dedutiva, recorre aos estudos documentais e análises estatísticas já colhidas. É vinculada ao Programa de Mestrado em Direito Negocial da Universidade Estadual de Londrina, linha de pesquisa Estado Contemporâneo: Relações Empresariais e Relações Internacionais, projeto de pesquisa Intervenção do Estado sobre o Domínio Econômico em face da Constituição Federal de 1988: Possibilidades de Reconfiguração das Relações entre Estado e Mercado.

A quarter-century after the enactment of the 1964 Civil Rights Act, its legacy remains controversial.
