La Ley 41/2015, de 5 de octubre, de modificación de la LECRIM introdujo en el ordenamiento procesal penal español, entre otras muchas e importantes reformas y a fin de imprimir máxima celeridad a la tutela judicial en los casos de delitos de escasa gravedad y descongestionar los órganos judiciales, el denominado «proceso por aceptación de decreto» del Fiscal. Este procedimiento de naturaleza monitoria permite la conversión de la propuesta sancionadora realizada por el Ministerio Fiscal en sentencia firme de condena cuando se cumplen los requisitos objetivos y subjetivos previstos y el encausado da su conformidad, evitándose —o, cuando menos, acortándose— la fase de instrucción a cambio de una sensible rebaja punitiva. En esta monografía los autores analizan de modo crítico, pero con espíritu constructivo —desarrollando propuestas para su mejora—, este novedoso procedimiento, destacando que el Fiscal está llamado a ser su protagonista indiscutible, lo que, a su juicio, constituye un primer guiño experimental del legislador a un sistema procesal que debe instaurarse de manera inminente en nuestro país, en el que el Ministerio Público dirigirá la instrucción penal y el Juez ejercerá exclusivamente la genuina función jurisdiccional.
