A necessidade de reconstrução do ethos referente ao Poder Judiciário a partir da ampliação dos processos decisórios e a inclusão de novos sujeitos, sobretudo os coletivos, ressaltam a importância e a urgência de um método adequado à compreensão da realidade judicante e sua relação com as múltiplas formas de dominação. A partir de categorias de Pierre Bourdieu, analisa-se a condição estrutural e estruturante do Judiciário como categoria dominante. Partindo da atuação do Conselho Nacional de Justiça, identifica-se em suas ações como órgão indutor e formulador de políticas públicas judiciárias um ethos de governança socioambiental que favorece princípios da chamada nova governança, entre eles: planejamento estratégico, transparência e abertura democrática. Embora represente um avanço ao Judiciário típico do século XIX, a governança judicial socioambiental esgota-se na aplicação de políticas públicas socioambientais e, por essa razão, não apresenta condições suficientes para alterações substanciais do processo de dominação que a realidade judicante contribui para fortalecer. Avaliam-se, então, as bases do socioambientalismo e as condições de constituição de um Poder Judiciário Socioambiental, assentado, sobretudo, na ampliação dos atores no processo decisório, especialmente às minorias e aos grupos tradicionalmente dominados. No socioambientalismo, com seu forte acento no pluralismo e ampliação de atores, encontram-se condições necessárias, embora não suficientes, para impulsionar um processo de alteração das condições dadas numa reação da heterodoxia versus a ortodoxia que permita a superação das condições de dominação que, pela atuação do Poder Judiciário, favorecem sociedades desiguais e injustas que atentam contra a dignidade humana. O paradigma Socioambiental fundado na dilatação dos espaços decisórios e envolvimento de atores sociais emancipatórios pode ser capaz de proporcionar uma nova jurisdição que proteja os novos bens e direitos socioambientais, além dos mais diversos atores no processo decisório judicante.

The author argues that the existing conceptual frameworks of political and social theory restrict both theorists and empirical researchers to a narrow definition of authoritarianism that focuses on governmental structure and fails to take account of forms of social control exercised outside the governmental sphere. Rather than define authoritarianism primarily by contrast to liberal democracy, Sciulli argues, we need to broaden our conception of authoritarianism to include "social authoritarianism," referring to social control imposed by private organizations and institutions, such as business corporations and professional associations. Until now, there has been no direct and extensive engagement with the category of religion from liberal political philosophy. Over the last thirty years or so, liberals have tended to analyze religion under proximate categories such as 'conceptions of the good' (in debates about neutrality) or 'culture' (in debates about multiculturalism). US constitutional lawyers and French political theorists both tackled the category of religion head-on (under First Amendment jurisprudence and the political tradition of laicite, respectively) but neither of these specialized national discourses found their way into mainstream liberal political philosophy. This is somewhat paradoxical because key liberal notions (state sovereignty, toleration, individual freedom, the rights of conscience, public reason) were elaborated as a response to 17th Century European Wars of Religion, and the fundamental structure of liberalism is rooted in the western experience of politico-religious conflict. So a reappraisal of this tradition - and of its validity in the light of contemporary challenges - is well overdue. This book offers the first extensive engagement with religion from liberal political philosophers. The volume analyzes, from within the liberal philosophical tradition itself, the key notions of conscience, public reason, non-establishment, and neutrality. Insofar as the contemporary religious revival is seen as posing a challenge to liberalism, it seems more crucial than ever to explore the specific resources that the liberal tradition has to answer it.

More than 50 percent of the global population resides in urban areas where land policy and infrastructure interactions facilitate economic opportunities, affect the quality of life, and influence patterns of urban development. While infrastructure is as old as cities, technological changes and public policies on taxation and regulation produce new issues worthy of analysis, ranging from megaprojects and greenhouse gas emissions to involuntary resettlement. This volume, based on the 2012 seventh annual Land Policy Conference at the Lincoln Institute, brings together economists, social scientists, urban planners, and engineers to discuss how infrastructure issues impact low-, middle-, and high-income countries. Infrastructure drives economic and social activities. For urban areas, the challenges of balancing economic growth with infrastructure development and maintenance are reflected in debates about finance, regulation, and location and about the sustainable levels of infrastructure services. Relevant sectors include energy (electricity and natural gas); telecommunications (phone lines, mobile phone service, and Internet); transportation (airports, railways, roads, waterways, and seaports); and water supply and sanitation (piped water, irrigation, and sewage collection and treatment). Recent research shows that inadequate infrastructure is associated with income inequality. This is likely linked to the delivery of infrastructure services to households, such as direct health benefits, improved access to education, and enhanced economic opportunities. Because so much infrastructure is energy intensive, efforts to reduce greenhouse gas emissions and other negative impacts must address services such as electric power and transport. Bringing the management of infrastructure up to levels of good practice has a large economic payoff, and performance levels vary dramatically between and within countries. A crucial unmet challenge is to convince policy makers and voters that large economic returns can result from improving infrastructure performance and maintenance.
