A presente investigação centra-se sobre a organização administrativa, a sua dinâmica, e as principais transformações verificadas no domínio das entidades de fins específicos constituídas pelo Estado. O Direito Administrativo não é apenas o Direito da conduta e do controlo da administração, é também o Direito da organização administrativa. Neste sentido, cabe destacar a importância do enquadramento das opções de organização num contexto mais amplo, assim como a perda de especificidade da pessoa coletiva pública e a consequente complexidade do seu processo de qualificação jurídica. A criação pelo Estado de pessoas coletivas de direito privado, a admissão de entidades particulares dotadas de funções públicas, a emergência de fórmulas organizativas mistas, quanto à composição e ao regime jurídico, vieram gerar disfunções profundas e perturbar os critérios de qualificação. Deste modo, em vez de uma clara distinção entre o universo das entidades públicas e o universo dos particulares e das suas organizações, emergiu uma escala de graduações múltiplas (que atinge inclusive o setor público administrativo), entre o núcleo das entidades inquestionavelmente públicas e o das pessoas coletivas puramente privadas. Daí a necessidade de estabelecer os critérios de qualificação jurídica de tais entidades, uma vez que a essa qualificação estão associadas diversas consequências jurídicas. A investigação divide-se em duas partes. Uma primeira, de enquadramento geral, dogmático, do problema da organização administrativa e da qualificação jurídica das entidades de fins específicos. E uma segunda, de reflexão crítica sobre as transformações mais significativas sofridas ao nível das entidades de fins específicos constituídas pelo Estado, em que se procura perceber os efeitos da uniformização do regime das empresas públicas sobre as suas formas de organização, refletir sobre o papel da fórmula fundacional no setor público administrativo, e compreender o enquadramento, na Administração Pública, das autoridades reguladoras independentes, à luz de uma nova ideia das funções do Estado.
