Esta obra tem como objetivo analisar, sob o enfoque do Direito, o meio ambiente cultural no Brasil e na Espanha, bem como a proteção dessa vertente ambiental, em face da omissão do Executivo, a partir da participação popular, com base ordenamento de cada Estado, mediante ações legitimamente propostas perante o Poder Judiciário. O primeiro capítulo trata da concepção existente no Brasil e na Espanha acerca do meio ambiente cultural – ainda que tal expressão, por diversas vezes, seja substituída por outras, como patrimônio histórico, patrimônio cultural etc. –, apontando-se nos dois Estados alguns institutos legais de proteção do referido objeto, assim como a divisão de competências estatais, do ponto de vista constitucional, para tratar da matéria, nos campos legislativo e material. O segundo cuida de abordar a questão da divisão de poderes ou funções estatais, e o alcance da atuação judicial nas ações ambientais, especialmente em face de constantes omissões do Poder Executivo. Serve ainda como local de discussão sobre o acesso à justiça e a participação popular, nos ordenamentos jurídicos brasileiro e espanhol, com o propósito de resguardar o meio ambiente cultural. O terceiro capítulo, por fim, tem como desiderato demonstrar, mediante exemplos práticos, situações reais envolvendo o meio ambiente cultural perante o Poder Judiciário dos dois países em destaque, ressaltando-se decisões que de uma forma ou de outra abordem os institutos referenciados no decorrer do livro.

Restorative justice has developed rapidly from being a barely known term to occupying a central role in debates on the future of criminal justice.
