O TEDH é hoje um tribunal muito diferente do instituído pelo Protocolo n.o 11 à Convenção Europeia dos Direitos Humanos. O estudo que se consagra neste livro rompe, por meio da teoria do diálogo transjudicial, com os paradigmas hierárquico e territorial por muitos apontado na relação entre o direito nacional e o direito internacional, a partir da construção de um sistema único de proteção judicial entre os direitos humanos e os direitos fundamentais. A forma como os tribunais argumentam em suas decisões segue uma matriz dialógica de ideias, em que uma decisão incorpora, diferencia ou alarga sentidos e premissas decisórias de outros precedentes estrangeiros, esvaziando qualquer relevância do escalonamento hierárquico de normas. Com o reconhecimento de uma única rede sistêmica de direitos humanos e direitos fundamentais, uma decisão do Tribunal Europeu de Direitos Humanos pode dialogar com algum juiz ou tribunal nacional do regime interamericano, sem que haja necessidade de se valer de procedimentos de internalização do direito estrangeiro na ordem jurídica interna. E mais do que isso, as cortes nacionais podem reinterpretar o direito interno interpretado pelos tribunais internacionais, ainda que a eles não estejam vinculados, e, ao mesmo tempo, as cortes internacionais ficam autorizadas a conferir nova interpretação à exegese dada pelos tribunais nacionais aos direitos humanos previstos em tratados ou convenções internacionais. Esse diálogo horizontaliza o liame entre juízes e tribunais de qualquer ordem jurídica que enfrentam questões relativas a direitos humanos e direitos fundamentais.
