Qual é o valor a ser dado à vontade da vítima de violência doméstica e conjugal quanto ao processo criminal tendente à punição do seu agressor? Pode ou deve esta vítima ter disponibilidade sobre ele, e em que grau? Essa é a questão problemática que guia a presente pesquisa, contextualizada na ampla conjuntura da violência de gênero, e instigada pelo comportamento cambiante que muitas vítimas dessa violência apresentam: denunciam que foram agredidas e, em seguida, pretendem que o procedimento penal não mais prossiga e, atendida a pretensão, voltam a queixar-se de nova e idêntica hostilidade. Nesse contexto, qual é o modelo ideal para a persecução penal desta violência, ou seja, por meio de ação penal pública ou privada? Essa questão é explorada a partir da dicotomia entre os princípios da oficialidade e da oportunidade no trato dos crimes nascidos das relações conjugais. Além disso, mas no mesmo contexto, são objeto de investigação os instrumentos de solução de conflitos propostos pela justiça restaurativa, se eles têm capacidade de ofertar respostas adequadas para os casos de violência conjugal. Um dos parâmetros tomados em consideração na busca dessas respostas são os efeitos, em especial de ordem psicológica, que a violência conjugal impõe à vítima.
