Canada’s official languages legislation fundamentally altered the composition and operational considerations of federal institutions. With legislative change, Canada’s public service has achieved the equitable representation of its two official languages groups, provided services to the public in both official languages, and has codified rights for public servants to work in their official language of choice. On paper, the regime is robust. In practice, there is a persistent divergence between policy and practice, as English dominates as the regular language of work in the federal public service. Through an historical institutionalist lens based on extensive archival research and semi-structured interviews, Gaspard shows that the implementation of official languages policy in the federal public service from 1967–2013 could not challenge the predominance of English as the operating language of the federal public service. The analysis of the roles of actors, ideas and institutions that influenced the policy implementation process show that a lack of structural change, inadequate managerial engagement, and a false sense that both official languages are equally ingrained in the public service explain the persistence of English as the dominant language of work. En adoptant une approche historique à cette question institutionnelle et au moyen de recherches archivistiques et d’entrevues mi-structurées, Gaspard fait valoir que de 1967 à 2013, la mise en oeuvre du programme de langues officielles à la fonction publique fédérale n’a pu influer sur la trajectoire de l’anglais comme langue prépondérante de travail. L’analyse des rôles des intervenants et des institutions qui ont façonné le processus met en lumière le fait que l’absence de changements structurels, l’engagement insuffisant des gestionnaires, de même que la perception erronée que les langues officielles sont toutes deux bien ancrées dans la fonction publique se conjuguent pour expliquer la persistance de l’anglais comme principale langue de travail. Insights from the application of economic theories and research methods to the management of linguistic diversity in an era of globalization. In an era of globalization, issues of language diversity have economic and political implications. Transnational labor mobility, trade, social inclusion of migrants, democracy in multilingual countries, and companies' international competitiveness all have a linguistic dimension; yet economists in general do not include language as a variable in their research. This volume demonstrates that the application of rigorous economic theories and research methods to issues of language policy yields valuable insights. The contributors offer both theoretical and empirical analyses of such topics as the impact of language diversity on economic outcomes, the distributive effects of policy regarding official languages, the individual welfare consequences of bilingualism, and the link between language and national identity. What challenges face jurisdictions that attempt to conduct law in two or more languages? How does choosing a legal language affect the way in which justice is delivered? Answers to these questions are vital for the 75 officially bilingual and multilingual states of the world, as well as for other states contemplating a move towards multilingualism. Arguably such questions have implications for all countries in a world characterized by the pressures of globalization, economic integration, population mobility, decolonization, and linguistic re-colonization. For lawyers, addressing such challenges is made essential by the increased frequency and scale of transnational legal dealings and proceedings, as well as by the lengthening reach of international law. But it is not only policy makers, legislators, and other legal practitioners who must think about such questions. The relationship between societal multilingualism and law also raises questions for the burgeoning field of language and law, which posits--among other tenets--the centrality of language in legal processes. In this book, Janny H.C. Leung examines key aspects of legal multilingualism. Drawing extensively on case studies, she describes the implications of the legal, practical, and ideological dilemmas encountered in a given country when it becomes bilingual or multilingual, discussing such issues as: how legal certainty and the linguistic ideology of authenticity may be challenged in a multilingual jurisdiction; how courts balance the language preferences of different courtroom participants; and what historical, socio-political and economic factors may influence the decision to cement a given language as a jurisdiction's official language. Throughout, Leung elaborates a theory of "symbolic jurisprudence" to explore common dilemmas found across countries, despite their varied political and cultural settings, and argues that linguistic equality as proclaimed and practiced today is a shallow kind of equality. Although officially multilingual jurisdictions appear to be more inclusive than their monolingual counterparts, they run the risk of disguising substantive inequalities and displacing real efforts for more progressive social change. This is the first book to offer overarching discussion of how such issues relate to each other, and the first systematic study of legal multilingualism as a global phenomenon.

Building on existing analytical frameworks, this book provides a new methodology allowing different language policies in international multilingual organisations (or “language regimes”) to be compared and evaluated on the basis of criteria such as efficiency and fairness. It explains step-by-step how to organise the evaluation of language regimes and how to design and interpret indicators for such evaluation. The second part of this book applies the theoretical framework to the evaluation of the language policy of the Patent Cooperation Treaty (PCT) division of the World Intellectual Property Organisation (WIPO) and the European Patent Office (EPO). Results show that an increase in linguistic diversity of the language regimes of patent organisations can both improve the efficiency of the patent system and lead to a more balanced distribution of costs among countries. This book is a resource for scholars in language policy and planning and for policy-makers in the international and European patent system.

Since the time of the royal commission of inquiry on bilingualism and biculturalism, federal official languages policy has been linked to the preservation of Canadian unity. The enshrinement of language rights in the Constitution in 1982 opened a new chapter in the evolution of these rights in Canada. In this document, we examine the three basic components of federal official languages policy: language rights protected under the constitution, the Official Languages Act, 1988, and support for the development of the official language minorities.
