Il volume raccoglie gli studi e gli approfondimenti dei principali temi che si sono proposti all’attenzione della Commissione di certificazione dei contratti di lavoro dell’Università degli Studi Roma Tre nei tredici anni trascorsi dalla sua operatività nel 2011. Il volume presenta un'analisi approfondita dell'evoluzione del ruolo del lavoro in somministrazione nel panorama del mercato del lavoro italiano, attraverso una lettura congiunta dei dati di fonte amministrativa e delle disposizioni normative che nel corso del tempo hanno regolato l’istituto con ispirazione più meno restrittiva. L’analisi evidenzia come questa forma di lavoro sia stata interessata da un quadro normativo in costante mutamento, dall’originario “pacchetto Treu” (1997) che ha aperto la strada al lavoro tramite agenzia in Italia, passando per il "decreto Biagi" (2003) che ha introdotto una maggiore flessibilità, fino alle restrizioni imposte dal "decreto Dignità" (2018) e ai recenti temperamenti alle restrizioni normative introdotti nel 2023. Viene messo in luce il ruolo fondamentale che le agenzie di somministrazione hanno avuto nel corso degli ultimi venti anni nel funzionamento del mercato del lavoro italiano e nella creazione di condizioni di occupazione stabile, confermato dai dati che mettono in risalto evidenze oggettive in parte distanti dalla comune opinione. Si sottolinea, a riguardo, l'importanza crescente delle tecniche di data science e di machine learning come strumenti chiave per garantire una maggiore trasparenza e tracciabilità nel mercato del lavoro, migliorando così l'efficienza dell'incontro tra domanda e offerta di lavoro e valorizzando il capitale umano in maniera più efficace. Viene anche proposta una riflessione sull'impatto delle politiche attive e passive nel rafforzare la qualità dell'occupazione offerta dalle agenzie di somministrazione, evidenziando come il principio di parità di trattamento rappresenti un presidio essenziale per la tutela dei lavoratori somministrati. I dati di utilizzo del lavoro in somministrazione, ricavati dal sistema delle Comunicazioni Obbligatorie, supportano le considerazioni giuridiche ed invitano ad una riflessione più ampia sull'adeguamento delle strategie di somministrazione alle dinamiche in rapida evoluzione del mercato del lavoro contemporaneo, sottolineando la necessità di un approccio interdisciplinare, più integrato e flessibile che tenga conto delle esigenze sia dei lavoratori che delle imprese in un contesto economico globale sempre più competitivo.
