Excerpt from Outlines of Equity A new Edition of these Lectures having been called for, my first care was to ascertain whether, notwithstanding the legal decisions and statutory enactments of the last seven years, they could still be considered useful to those for whose information they were originally published. The result of a careful reperusal of them was to satisfy me that, except in respect of the alterations introduced by the Married Women's Property Act, 1870, and those infused into the practice of the Court of Chancery by the 25th & 26th Vict., cap. 42 (Rolt's Act), the text might be treated as little affected by the lapse of time; and the Lectures have, therefore, been reprinted with notes explaining the effect of subsequent legislation and referring to the recent decisions applicable to the questions discussed. Excerpt from Equity and Its Remedies This book is the outcome of lectures delivered by the author at the Evening Law School of the Boston Y. M. C. A. And at the Law School of Boston Univer sity, on the equitable remedies. The justification for putting the material in this form is found in the expressions of gratitude from former students who have been good enough to say that they have found in these lectures citations and statements of principles inaccessible in any text-book. The frequency with which the author has turned to these notes for cita tions in his own practise has convinced him that others of the profession may be able to find assistance from the same source. The book is an attempt to give a rational outline of equity (exclusive of trusts and kindred subjects) and to show the scope of the equitable remedies. It does not attempt to deal with strictly statutory subjects or with equity pleading or practice. While the citations are largely drawn from Massa chusetts cases (and Ames's Cases on Equity), it is believed the subject is treated in such a way as to make the book of general application, useful to the student or practitioner in any part of the United States. No attempt has been made to cite all the equity cases decided in Massachusetts, although cer tain parts of the subject, not covered by existing text-books, have been treated with thoroughness. It must be remembered that this is a book intended for the use of students, and it is not an encyclopaedia. What a student requires primarily is a generalization; and I would ask those who would controvert the accuracy of my view, what logical justification exists for insisting upon the reproduction of enactments at length, and at the same time admitting that stating the substance of decided cases, and not reproducing the report at large, is the correct method of discussion. It is sufficient, as it seems to me, that a student should have his attention directed to the fact that there is a statutory power to apply the income of infant's property in mainte nance by sect. 43 of the Conveyancing Act, 1881, and that there is a statutory power given to the Court, or to the parties, to appoint new trustees.
