The 19th Symposion of the International Society for Greek and Hellenistic Legal History took place in Cambridge MA, August 26-29, 2013. 15 papers were presented, and respondents opened the discussion about every paper. Every two years, the Society for Greek and Hellenistic Legal History, founded by Hans Julius Wolff, convenes a symposium that gathers a small circle of legal historians, ancient historians, classical philologists, epigraphers and papyrologists who present the results of their most recent work for discussion. This volume contains the papers given in seminars between 28 February and 16 May 1986 in London. Scholars with an interest in legal history, but working in different areas of the Ancient World - Egypt, Babylonia, Palestine, the Greek East - were invited to look at the way on which the various legal systems interacted, or reacted against one another, once Alexander had imposed Greek law on the countries he had conquered. Since only a few fragments of the actual laws survive, a reconstruction of the different legal systems has to rely to a large extent on the documents which these systems produced. For this reason it seemed best to concentrate on the documents themselves, looking at them from a comparative point of view, in order to discover how the legal texts of the Hellenistic period, written in Greek, Egyptian (Demotic), Akkadian and Aramaic, deal with land-ownership, family law, testaments, temple law, laws of obligations, and the legal position of slaves. The ancient Greeks invented written law. Yet, in contrast to later societies in which law became a professional discipline, the Greeks treated laws as components of social and political history, reflecting the daily realities of managing society. To understand Greek law, then, requires looking into extant legal, forensic, and historical texts for evidence of the law in action. From such study has arisen the field of ancient Greek law as a scholarly discipline within classical studies, a field that has come into its own since the 1970s. This edited volume charts new directions for the study of Greek law in the twenty-first century through contributions from eleven leading scholars. The essays in the book’s first section reassess some of the central debates in the field by looking at questions about the role of law in society, the notion of “contracts,” feuding and revenge in the court system, and legal protections for slaves engaged in commerce. The second section breaks new ground by redefining substantive areas of law such as administrative law and sacred law, as well as by examining sources such as Hellenistic inscriptions that have been comparatively neglected in recent scholarship. The use of writing in the development of Greek law was unique. In this comparative study Professor Gagarin shows the reader how Greek law developed and explains why it became so different from the legal systems with which most legal historians are familiar. While other early communities wrote codes of law for academic or propaganda purposes, the Greeks used writing extensively to make their laws available to a relatively large segment of the community.
