The contemporary discourse on maritime security is highly focused on asymmetric threats and challenges confronting the international community. Among these, terrorism and sea piracy have attracted greater attention. These issues have figured prominently in statements and speeches by the political leaderships across the globe and international organizations such as the United Nations, which have attempted to address it through a number of resolutions and conventions, and the national security strategy documents of several countries have incorporated these in their strategic calculations and operational doctrines. The international community has responded firmly to these threats and challenges through a number of political, diplomatic, security, legal and financial initiatives with positive results. Likewise, the international shipping industry has expressed concern about the threat of piracy and joined hands with the governments and instituted best business practices to protect ships against pirate attacks. In recent times, the Gulf of Aden has witnessed a rise in incidents of piracy which has threatened sea-based commerce transiting though the area. There have been a number of hijackings, large sums of ransom money has been paid to the pirates for the release of crew, and perhaps the most disturbing aspect of the Somali piracy is that some crew members were killed due to non-payment of ransom. Furthermore, the Somali pirates have expanded their reach far and wide into the Indian Ocean including the Red Sea, Coast of Oman, Arabian Sea, waters around the Maldives, and the western seaboard of India. The shipping industry has urged the United Nations and national governments to take necessary action under various UN Security Council (UNSC) resolutions to curb piracy, deploy naval assets and punish the criminals. Also a number of international initiatives and responses such as multinational naval operations, improved politico-diplomatic international cooperation, adoption of improved onboard security measures by the shipping companies, positioning of private security guards onboard ships, and a number of national legal reforms to address piracy have resulted in a decrease in the number of hijackings.

The pirates of Somalia have shaken the maritime world. They have mounted what amounts to the most substantial non-state threat to the security of international shipping for half a century and perhaps longer. Piracy outbreaks have also occurred in Southeast Asia and West Africa. In each case the international community has responded differently. What lessons can be learned from three different approaches and is it possible to distill lessons of international best practice that can be applied in the Gulf of Aden and the northern Arabian Sea? This paper will examine how and why these three piracy outbreaks arose. It will describe in particular why the threat off Somalia grew so rapidly, why it declined and why the elements that made it successful remain in place. It will examine the responses of the international community, asking whether or not the response off Somalia might have been more effective if it had benefitted from stronger international backing and more coherent coordination. It will make the point that maritime security – the prevention and suppression of disorder at sea – must address many more issues than piracy as the theft of fish and the movement of drugs; weapons and people can often present greater risks. It will build on this point by looking at maritime security developments drawn from all three regions that may be employed advantageously in the Gulf of Aden and Arabian Sea, before circling back to look at the fundamental problem, which is one of landward security and asking what initiatives have been taken to address this in Somalia and which ones appear to be yielding results. Finally, it will examine whether the way forward does lie with a unified global initiative, or if steps are better taken regionally calling upon extra-regional support as necessary.

Unregulated or lesser regulated maritime spaces are ideal theatres of operation and mediums of transportation for terrorists, insurgents and pirates. For more than a decade, the Indian Ocean waters adjoining Somalia have been a particular locus of such activities, with pirates hijacking vessels, and Al Qaeda and Al Shabab elements travelling between Africa and the Arabian Peninsula, operating lucrative businesses and even staging deadly operations at sea. According to figures from 21 October 2011 provided by the International Maritime Bureau ́s Piracy Reporting Center, 13 vessels and 249 hostages are currently held by Somali pirates. A total of 208 incidents were reported, 24 of which were hijackings . In fact, Somali piracy is nothing new. It only appears to be new because Somalia ́s geostrategic position happens to be along one of the major Sea Lines of Communication (SLOC). Had that not been the case and had western shipping not been affected, the world had taken little notice of the problem. Until 2008 the pirates almost refrained from killing hostages and were exclusively after ransom. Younger incidents, starting with the Le Penant in 2008 show a change in attitude. Pirates have become more brutal, starting to torture and kill, and there have been demands to release fellow pirates from prisons rather than to deliver ransom, such as 2010 in the Asphalt Venture case. Although such can still be considered piracy, this element brings back memories of hijackings by extremist groups such as the 1977 Landshut case or the 1985 Achille Lauro incident. The essay explains the general Somali piracy problem and why it is so contrary. Piracy is always a regional phenomenon and never a global threat, which goes back to the condition that it is – and has to be – always linked to the political situation on land. That said, selective investments as suggested by some cannot work in the Somali environment as a solution because the understanding of business in this part of the world differs from ours. Others say that the only viable way is to treat all entities in Somalia equally. The current essay supports his view, although that seems the more difficult way. Much if not all depends on the overall stability of Somalia but the maritime threats should be addressed more effectively today, which is why the essay also discusses possible naval approaches. May it be capacity building on land or fighting pirates at sea – if the coalition does not act quickly, the initiative will most certainly be taken over by private security companies, which is partly already the case today. In any way, with the right methods and means in place it should be able to eradicate Somali piracy. But it will take time, which most of the affected individuals do not have.

Somali piracy poses a threat to the UK's national interests as well as global trading routes and international security. The costs of allowing piracy to proliferate are high. The British shipping industry is worth £10.7 billion to the UK's GDP, and the costs of security, insurance, re-routing have vastly increased the costs of doing business. Over $300 million has been paid in ransoms to Somali pirates over the past four years, and thousands of seafarers have been held hostage, some of whom have been subject to cruel treatment and even torture. Self-defence measures, multi-national naval operations and prosecutions have begun to take effect, but have not yet contained the problem. The major international conference on Somalia in February 2012 must produce results. Although private armed guards will be permitted on UK shipping, the Government's guidance on the use of force, particularly lethal force, is very limited and there is little to help a ship's master make a judgement on where force can be used. The Committee also expresses surprise that so little is known about what happens to ransom money. The solution lies in establishing order on land, ending impunity for piracy crimes and offering alternatives. However, the report warns against international claims to deliver a solution in Somalia, and urges the Government to develop its engagement with and support for Somali civil society organisations and local projects. The FCO should also review its communication and other procedures to support family members of British hostages held abroad.

The waterways and ports such as Bab el-Mandab and the port of Aden are areas of continuing economic, strategic and grand strategic interest to the international community; they are all of parallel geostrategic importance. Therefore, there are compelling reasons for concrete actions to step up security in the strategic waterways and ports at a time when terrorists are looking for soft targets. The fact is that the security of the Red Sea, Bab el-Mandab Straits, Gulf of Aden, and Arabian Sea, are among the world’s busiest waterways. Yemen’s cooperation with the international community is part of an ambitious effort to improve security worldwide and this cooperation will develop further. Given the strong and multilateral interest of the international community in the Red Sea, Bab el-Mandeb Straits, the Gulf of Aden and Arabian Sea, the littoral states must do their best to provide sufficient security against piracy in order to achieve stability in the region and worldwide. The international community and regional countries should agree on means that can be taken by each respective state individually and collectively. Maritime safety is considered an essential element of economic security for Arab countries and the rest of the world, and therefore the Arab world should support and back international and regional joint efforts. Such regional endeavors to protect maritime shipping lanes from any threat including piracy, in addition to capacity building of maritime security workers, all represent the core of bilateral and multilateral partnership among concerned maritime organizations and Arab states. Because of this it is important for Arab states to expand their diplomatic relations regionally and internationally on the basis of enhancing their security capabilities, including access to necessary training, joint naval maneuvers, and keep up with international maritime developments.

Piratical attacks have become more frequent, violent, costly and increasingly threaten to undermine order in the international system. Much attention has focused on Somalia, but piracy is a problem worldwide. Recent coordination efforts among states in South East Asia appear to have helped in the area, but elsewhere piracy has expanded. Interestingly, international law has long recognized piracy as a crime and provided tools for universal suppression, yet piracy persists. In this book, a handpicked group of leading experts in the field of International Relations use maritime piracy as a means to expose the incongruities in our understanding of global governance. Using broadly constructivist approaches to understand international actors’ responses to the challenges created by maritime piracy, the contributors question a number of myths and misconceptions around piracy and analyze the various ways that international law and organizations channel actors’ understandings of maritime piracy and their efforts to respond to it.
