Les nouvelles technologies et le droit ont donné lieu à de nombreuses études, que cela soit ce qui est maintenant couramment nommé la cybercriminalité ou encore le droit des communications électroniques. Cependant, un aspect pourtant essentiel a été peu traité, il s'agit de la protection des données personnelles alors que celles-ci sont une réalité quotidienne. Soumis à des contrôles biométriques, utilisant des titres de transports équipés de puces RFID, faisant un emploi quotidien de l'informatique, d'internet et des téléphones mobiles, ce sont des quantités phénoménales de données à caractère personnel qui sont générées chaque jour. Souvent négligée, la loi " informatique et libertés " est pourtant l'instrument indispensable pour protéger nos libertés et droits fondamentaux, du droit au respect de la vie privée en passant par la dignité humaine. Si jusqu'en 2004, il était difficile de traduire les notions et les régimes de cette loi en un droit effectivement invocable devant un juge pour obtenir la sanction ou la réparation de l'utilisation sans droit de données à caractère personnel, la loi s'attachant à un formalisme pouvant apparaître comme dénué d'enjeux de fond, la réforme introduite par la loi du 6 août 2004 a permis de replacer la personne au centre de cette protection et, avec elle, de dessiner le droit à la protection des données à caractère personnel en tant que droit subjectif et droit de la personnalité. Ce nouvel instrument devra répondre à la démultiplication des situations où les données à caractère personnel sont employées, mais c'est surtout le plan international qui reste à ce jour le plus grand défi à relever.

Although Europe has a significant legal data protection framework, built up around EU Directive 95/46/EC and the Charter of Fundamental Rights, the question of whether data protection and its legal framework are ‘in good health’ is increasingly being posed. Advanced technologies raise fundamental issues regarding key concepts of data protection. Falling storage prices, increasing chips performance, the fact that technology is becoming increasingly embedded and ubiquitous, the convergence of technologies and other technological developments are broadening the scope and possibilities of applications rapidly. Society however, is also changing, affecting the privacy and data protection landscape. The ‘demand’ for free services, security, convenience, governance, etc, changes the mindsets of all the stakeholders involved. Privacy is being proclaimed dead or at least worthy of dying by the captains of industry; governments and policy makers are having to manoeuvre between competing and incompatible aims; and citizens and customers are considered to be indifferent. In the year in which the plans for the revision of the Data Protection Directive will be revealed, the current volume brings together a number of chapters highlighting issues, describing and discussing practices, and offering conceptual analysis of core concepts within the domain of privacy and data protection. The book’s first part focuses on surveillance, profiling and prediction; the second on regulation, enforcement, and security; and the third on some of the fundamental concepts in the area of privacy and data protection. Reading the various chapters it appears that the ‘patient’ needs to be cured of quite some weak spots, illnesses and malformations. European data protection is at a turning point and the new challenges are not only accentuating the existing flaws and the anticipated difficulties, but also, more positively, the merits and the need for strong and accurate data protection practices and rules in Europe, and elsewhere.

Généralement présenté comme une matière réservée aux initiés, le droit des données à caractère personnel intéresse pourtant le plus grand nombre. Les technologies de l'information sont si répandues que les menaces liées à leurs usages pèsent sur tous. L'effectivité de la protection des personnes se révèle être l'enjeu majeur de ce droit. Pour endiguer les risques d'atteinte aux personnes, le domaine des données à caractère personnel s'est étendu. Pouvons-nous considérer que cette expansion, façonnée au fil des interprétations et modifications législatives, débouche sur une meilleure protection des personnes ? Cela n'est pas certain. Pour parvenir à cette fin, il a été jugé opportun d'encadrer la notion de donnée à caractère personnel. Cette qualification doit être limitée aux données directement identifiantes et aux données indirectement identifiantes dont le traitement induit un lien avec une personne physique. Cette approche a appelé un renforcement du régime juridique associé. Les règles actuelles de cette matière, bien que nombreuses et enchevêtrées, sont favorables à la mise en œuvre des traitements et les atteintes à la liberté d'autodétermination sont peu encadrées. Afin de prévenir les risques d'atteinte aux personnes, un raffermissement de certains principes a été proposé. C'est surtout une meilleure mise en œuvre de ce droit qu'il a fallu garantir. Celle-ci passe par une intensification et une diversification des contrôles. Elle se matérialise surtout par une amélioration de la réalisation juridictionnelle du droit des données à caractère personnel, qui doit reconnaître aux personnes des moyens effectifs pour agir et défendre leurs données.
