How have the arrangements in European countries regarding the functioning of justice changed in the period of the COVID-19 pandemic? Will the solutions implemented in various countries in the context of the COVID-19 pandemic last and find their place in the legal systems of these countries for a longer period of time? The contributors analyse this in four thematic blocks: The first refers to the impact of COVID-19 on the administration and technical functioning of the judiciary, including international courts. The second part focuses on the impact of COVID-19 on the model of civil procedure, including the effects on general and structural principles such as the principle of openness, writing and oral proceedings, the principle of consistency of panels of judges as well as digitalization. The third refers to the impact of COVID-19 on criminal proceedings. And the last one deals with the impact of COVID-19 on the administrative proceedings.

Poland has been in a phase of change since 2015. The constitutional system of the Third Republic is being restructured. The Judiciary, media, schools and universities are the main focus of attention. This restructure is being celebrated by the government as a renewal of the Polish state, but is being branded by the opposition as the destruction of the Polish Republic in favour of an illiberal democracy. In this already very difficult situation, Poland was confronted with the major challenges posed by a pandemic. What effects will the crisis have on the restructuring of the constitutional system? At present, it seems that the pandemic is acting as a catalyst for those changes. This book aims to provide an informed commentary on those developments and what they mean for the Third Polish Republic.

Leadership In The Time Of Covid written by George Hays II and has been published by Central European University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2023-10-30 with Political Science categories.

The Covid pandemic has put all modern societies to a serious test of resilience. The interdisciplinary research on which this book is based examined how four European governments behaved in these circumstances. During the months of the crisis, the team of experts coordinated by the editors of this volume took a close look at the decision-making processes in the Czech Republic, Hungary, Poland, and Slovakia – the so-called Visegrad Four. The inquiries focused on experiences from the academic, health, economic and social fields. The methods of comparison included surveys, interviews, discourse analysis, for which the adaptive leadership theory provided the conceptual framework. The conclusions are both academic and practical. Aside the description of the pandemic responses, the research had a formative dimension: how can an adaptive leadership approach better help societies manage the health and societal impacts of similar challenges? The spectrum of emerging anti-democratic tendencies in the region provided the specific context of the exercise. The four states face varying degrees of democratic backsliding as well as illiberal influences that have affected their response to the pandemic, which gives this research on the Visegrad Four a worldwide resonance.

The volume: Analyzes the risks and effectiveness of the policy strategies taken by political regimes within states of central Europe; Probes into the changes in the functioning of post-pandemic society, especially the limitations of human rights due to state coercion and corruption risks; Understands issues related to the law-making process, healthcare policy, digitisation of state institutions and key processes carried out by entities of the system of public authority, and the establishment of principles and mechanisms of cooperation between the state and the business environment; Distinguishes the approaches of central and local administrations and of public authorities and citizens to the pandemic phenomenon; Assesses the actions taken by NATO and the national armed forces in the fight against the COVID-19 pandemic, with particular emphasis on the situation in the Visegrad Group countries. A timely study, this will be of great interest to scholars and researchers of political theory, sociology, public health and social care, governance, public policy, security studies and public administration.

Rule Of Law And The Challenges Posed By The Pandemic written by Rainer Arnold and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2023-11-22 with Law categories.

The rule of law represents the heart of constitutionalism. Public power can only be legitimately exercised if it is based on and complies with the law. The Constitution and its fundamental values – human dignity, freedom and equality – are the ultimate sources of orientation for the rule of law. Domestic rule of law is complemented by its external dimension, the duty to respect international law and, for EU member states, supranational law. For the World Jurist Association, the realization of the Rule of Law has been the central concern since its founding more than 60 years ago. Its biennial world congresses, which bring together leading figures from politics, the judiciary and academia under the presidency of Javier Cremades, focus on the universal importance of the rule of law, which experts from numerous countries discuss on the basis of current problem areas. At the 2021 World Law Congress in Barranquilla, Colombia, one central topic was the tension between combating pandemics and the rule of law. The contributions gathered here examine how this challenge was met in political-legal practice, and the role of constitutional jurisdiction in the process. They analyze and evaluate the legal situation in numerous countries in Europe and Latin America. In addition, they reflect on fundamental issues, such as the concept of the rule of law, its relationship to democracy, its universal character and its implementation via jurisprudence.

This book examines human rights and penitentiary law in Central Eastern European and Latin American countries from a comparative perspective. How are penitentiary systems and human rights currently being transformed in both regions? This question guides contributors hailing from both Central Eastern Europe and Latin America, filling the gaps at both the international and national level. The book compares Central Eastern European countries with Latin American countries, shedding new light on similarities and differences alike. The main themes of this book are the analysis of penitentiary systems in different countries and a general analysis of criminal and criminological issues. The respective chapters examine how penitentiary laws are changing within different contexts and regulatory regimes. The book seeks to cross boundaries to understand new divisions, fragmentations, and forms of authoritarianism in today’s world, more specifically in Poland, North Macedonia, Chile, Argentina, Peru and Mexico.
