L'évolution contemporaine de l'application du droit pénal permet d'observer au moins deux phénomènes significatifs. D'une part, on constate une dissociation de plus en plus fréquente entre le prononcé du jugement pénal et son exécution, avec comme conséquence que cette exécution n'est plus seulement rejetée dans l'ombre, mais totalement ou partiellement absente. D'autre part, se multiplient des mécanismes aboutissant à ce que la déclaration de culpabilité de l'auteur d'une infraction ne s'accompagne d'aucun autre prononcé. Fruits notamment d'un double mouvement d'individualisation et de diversification des peines, de tels phénomènes aboutissent inévitablement à une valorisation croissante du prononcé de la peine par rapport à son exécution, voire même de la déclaration de culpabilité par rapport au prononcé de toute autre condamnation. Loin d'apparaître comme des manifestations d'impunité, ces phénomènes constituent davantage une forme de passage à la limite d'une pénalité «immatérielle» où l'acte de punir se ramène à un pur acte de langage, consistant à réaffirmer la loi, à dire le crime, à désigner son auteur et à reconnaître publiquement le statut de la victime. Centré sur l'étude du jugement pénal, le présent ouvrage s'attache ainsi à développer l'idée que le dire apparaît non seulement comme un élément constitutif de l'acte de punir, voire comme une peine à part entière, mais encore, dans leur prolongement, comme un véhicule essentiel de leur mémoire et de leur oubli. Si l'analyse porte principalement sur les droits belge et français, elle s'étend également à d'autres systèmes juridiques

Refuser toute violence, c'est aller vers une société où le paradigme punitif cède la place au soin, à l'éducation, à la médiation, à la protection des personnes. Abolir la prison, et le Code pénal, suppose un changement de regard : l'autre, dans une altérité parfois très difficile, reste un être de parole et ne peut être l'objet de coercition. Puissent ces lignes ouvrir un nouvel horizon qui exclue radicalement la violence.

Le titre provocant de cet ouvrage, dans le style des conseils aux éducateurs du XIXe siècle n’abuse personne et fait la part de l’humour. En effet, ce livre est sensible et favorable aux enfants. Néanmoins il faut bien avouer que de tout temps les punitions ont fait partie de l’éducation des enfants et coloré vivement les relations qu’ils ont avec leurs parents et les adultes qui exercent une autorité sur eux. Aujourd’hui on les minimise, on en dénie l’emploi, et pourtant elles persistent plus ou moins... camouflées, rationalisées. Sont-elles nécessaires ou peut-on éduquer sans sévir ? Quelles sont les modalités des punitions ? Comment les voient ceux qui punissent et ceux qui sont punis ? Où se situe la frontière entre sévices et punitions ? Qu’en pensait Freud qui avait six enfants ? Pourquoi punit-on les enfants ? Les enfants recherchent-ils, provoquent-ils les punitions ? Qu’écrivait la « divine » comtesse de Ségur en 1850 ? Quelle est l’histoire du fouet, de la discipline à l’école ? Que disent d’eux-mêmes les maîtres et que disent les élèves de leurs maîtres ? L’enfant psychotique ou retardé mental doit-il en être exempté ? Existe-t-il des méthodes rationnelles d’éducation sans punition aucune ? Telles sont les principales questions qui se posent chaque jour à tout parent ou éducateur, professionnel ou non. Il n’y a pas de manuel pour y répondre et, de toute façon, aucun délai pour surseoir à l’instant. Ce livre apporte avec franchise une approche transdisciplinaire. Michel Soulé
