Studienarbeit aus dem Jahr 2019 im Fachbereich Jura - Öffentliches Recht / Staatsrecht / Grundrechte, Note: 1,0, , Sprache: Deutsch, Abstract: Die Arbeit beschäftigt sich mit institutionellem Rassismus innerhalb der Bundespolizei am Beispiel des Racial Profiling und stellt sich der Frage, inwiefern diese Verwendung in der Polizei findet und welche Konsequenzen es für unseren Rechtsstaat und betroffene Personen hat. Im Schlussteil werden anhand der erarbeiteten Ergebnisse Maßnahmen auf juristischer, politischer und bildungspolitischer Ebene diskutiert, um die Möglichkeit einer Sensibilisierung der Sicherheitsbehörden für Racial Profiling aufzuzeigen. Auch wenn das deutsche Grundgesetz in Artikel 3 Absatz 3 definiert, dass kein Mensch aufgrund der oben genannten Merkmale diskriminiert werden darf, weicht die Realität sowohl im Alltag als auch in Institutionen, die dem deutschen Grundgesetz direkt unterstellt sind, stark von der juristischen Grundlage ab. Der Bericht der Arbeitsgruppe „Experts on People of African Descent“ (Dt.: Expert*innen für Menschen der afrikanischen Diaspora) der Menschenrechtskommission der Vereinten Nationen warnt eindringlich, dass Schwarze Menschen und People of Color (POC) in der weißen Mehrheitsgesellschaft in Deutschland täglichem Rassismus ausgesetzt sind. Der Bericht bezieht sich explizit auf den institutionellen Rassismus innerhalb des deutschen Justizsystem und der Sicherheitsbehörden, dessen Existenz von Seiten der Bundesregierung bislang per se geleugnet wird. Der Bericht der Menschenrechtskommission listet Fälle polizeilicher Gewalt gegenüber Schwarzer Menschen und POCs auf, die sie als Konsequenz des institutionellen Rassismus dokumentieren. Darunter der Fall von Oury Jalloh aus Sierra Leone, der 2005 in polizeilichem Gewahrsam in seiner Zelle verbrannt ist. Bis heute sind die genauen Todesumstände unklar. Während die Polizei den Tod als einen Selbstmord darstellt, gehen Angehörige Jallohs und Menschenrechtsaktivist*innen einschlägig von Mord aus rassistischen Beweggründen aus. Der Prozess wurde eingestellt, obwohl er nicht nachhaltig geklärt werden konnte. Zwei Polizisten wurden angeklagt, davon wurde einer zu einer Geldstrafe verurteilt und der andere freigesprochen. Sowohl der Staat als auch polizeiliche Institutionen verharmlosen Ereignisse wie den von Oury Jalloh als „unglückliche Einzelfälle“, und leugnen damit den Rassismus innerhalb deutscher Institutionen, auf den Nichtregierungsorganisationen (NGOs) seit Jahren aufmerksam machen.

This edited book brings together humanities and social sciences scholars from the various disciplines at the nexus of discourse studies and ethnography to reflect on questions of institutional practices and their political concerns. Institutional order plays an important role in structuring power relations in society. Yet, contrary to common understandings of structure, institutional orders are far from fixed or stable. They constantly change, and they are resisted and reimagined by social actors. The 20 studies collected in this edited volume develop the notion of institutionality as an overarching perspective to explore how institutional actors and institutional practices order and reorder power in societies across the globe. Thereby the chapters pay special attention to the fluidity, volatility, fragility, and ambiguity of order, and consequently to its claims to authority. Employing a broad range of discourse analytic and ethnographic methodologies, the studies show how institutions are discursively and materially constructed, defined, represented and how they are made relevant and become powerful – or how they are resisted, transformed or lose significance – in interaction.
