La Délégation aux droits des femmes et à l’égalité des chances entre les hommes et les femmes a souhaité se saisir de cette réforme importante du cadre de la démocratie sociale, en concentrant ses travaux sur certaines dispositions du projet de loi relatif au dialogue social et à l'emploi déposé le 22 avril 2015 à l'Assemblée nationale. Elle a adopté 25 recommandations concernant la représentation des femmes dans les instances de représentation des salariés , la négociation collective sur l’égalité professionnelle , la réforme des dispositifs de soutien aux travailleur-se-s modestes, avec la création d’une prime d’activité , ainsi que d’autres réformes engagées concernant le régime de l’intermittence et la sécurisation des parcours professionnels .

Une Délégation aux droits des femmes et à l’égalité des chances entre les hommes et les femmes a été instituée, dans chacune des assemblées, par la loi n° 99-585 du 12 juillet 1999 issue d’une initiative du groupe socialiste . Les délégations, dont chacune compte 36 parlementaires, sont chargées d’informer le Parlement de la politique suivie par le Gouvernement au regard de ses conséquences sur les droits des femmes et sur l’égalité des chances entre les femmes et les hommes, et assurent, en ce domaine, le suivi de l’application des lois. Elles peuvent également être saisies sur un projet ou une proposition de loi . Aux termes de la loi, les délégations « établissent, chaque année, un rapport public dressant le bilan de leur activité et comportant, le cas échéant, des propositions d'amélioration de la législation et de la réglementation dans leurs domaines de compétence ». Le présent rapport dresse ainsi le bilan de l’activité de la délégation de l’Assemblée nationale entre janvier et décembre 2014 et, cette année encore, de nombreux travaux ont été engagés sur des problématiques très variées, avec la volonté constante de défendre les droits des femmes dans le cadre d’une approche intégrée de l’égalité, donc nécessairement large et transversale.

La Délégation a souhaité être saisie du projet de loi visant à « instituer de nouvelles libertés et de nouvelles protections pour les entreprises et les actifs », qui a été adopté en Conseil des ministres le 24 mars 2016. Une série d’auditions ont été organisées avec des représentantes d’associations féministes ou œuvrant sur le terrain pour promouvoir l’insertion professionnelle des femmes, expert.e.s et membres du Conseil supérieur de l’égalité professionnelle entre les femmes et les hommes (CSEP), représentant.e.s d’organisations syndicales de salarié.e.s et de l’Union professionnelle artisanale (UPA). Ce cycle d’auditions s’est conclu par l’audition de la ministre Myriam El Khomri, le 30 mars 2016. Le présent rapport analyse tout d’abord les principales caractéristiques de l’emploi et du travail des femmes afin de pouvoir mieux appréhender l’impact du présent projet de loi, et tenter de pallier ainsi les carences de l’étude d’impact sur ce point. Il rappelle également les nombreuses avancées intervenues dans ce domaine depuis 2012. Dans une seconde partie, le présent rapport examine les différentes mesures du projet de loi sur lesquelles l’attention de la Délégation a été appelée. Celles-ci concernent principalement les principes essentiels du droit du travail qui doivent guider la réécriture de la partie législative du code du travail (article 1er), les dispositions relatives aux temps de travail, s’agissant plus particulièrement de celles relatives au temps partiels (articles 2 à 5), ainsi que la réforme du dialogue social, compte tenu de ses impacts sur la négociation collective en entreprise sur l’égalité professionnelle (articles 10 à 18). Vos rapporteures ont également examiné les dispositions du projet de loi relatives au compte personnel d’activité (articles 21 et 22), au droit à la déconnexion et au télétravail (articles 25 et 26) ainsi qu’à la médecine du travail (article 44). Par ailleurs, ce projet de loi doit être complété afin notamment de clarifier les modalités de négociation collective sur l’égalité, suite à la loi du 17 août 2015, et de renforcer la lutte contre les agissements sexistes, harcèlements sexuels et discriminations.
