Les rapporteurs Jean-Michel Clément et Guillaume Larrivé ont choisi de consacrer la première partie du présent rapport à une évaluation de l’application de la loi du 7 mars 2016 et à un diagnostic sur la situation présente du droit des étrangers, qu’il s’agisse de l’augmentation des flux migratoires, de l’extrême complexité du droit en vigueur ou des difficultés rencontrées par les autorités publiques et les acteurs de terrain compétents en la matière.Le rapporteur Jean-Michel Clément a souhaité compléter cette évaluation et ce diagnostic par un certain nombre de préconisations. • Proposition n° 1 : Augmenter la durée de la retenue administrative pour vérification du droit au séjour et élargir la possibilité dans ce cadre de prise et d’enregistrement des empreintes digitales • Proposition n° 2 : Prévoir la possibilité d’accorder l’aide au retour volontaire à un étranger placé en rétention • Proposition n° 3 : Supprimer l’Obligation de Quitter le Territoire Français (OQTF) dite « six semaines » • Proposition n° 4 : Porter à quarante-huit heures le délai donné au JLD pour se prononcer sur le placement en rétention • Proposition n° 5 : Donner cinq jours au juge administratif pour statuer sur la légalité de l’OQTF visant un étranger placé en rétention • Proposition n° 6 : Confier au juge judiciaire le contentieux du maintien en rétention en cas de demande d’asile • Proposition n° 7 : Renforcer l’harmonisation des pratiques d’évaluation des mineurs non accompagnés • Proposition n° 8 : Garantir, pour tout étranger en demande de prise en charge, se disant mineur et isolé, une mise à l’abri dans des conditions dignes et au moins un entretien avec les services compétents mandatés par le département • Proposition n° 9 : Prévoir la délivrance d’un récépissé, à la date d’expiration de leur titre de séjour, aux étrangers malades qui sollicitent le renouvellement de ce titre • Proposition n° 10 : Prévoir la délivrance d’un titre de séjour d’un an renouvelable aux parents d’enfant étranger malade • Proposition n° 11 : Réfléchir aux moyens de reconnaître juridiquement et de mieux garantir les droits des personnes dépourvues de titre de séjour et non éloignées • Proposition n° 12 : Abroger la circulaire du 12 décembre 2017 relative à l’examen des situations administratives dans l’hébergement d’urgence

Chacune des sessions de la XIVe législature a été marquée par une forte activité pour la commission des Lois constitutionnelles, de la législation et de l’administration générale de la République. La session 2015-2016 a donné lieu à une nouvelle progression. Présidée par M. Dominique Raimbourg depuis le 3 février 2016, à la suite de la nomination de M. Jean-Jacques Urvoas en qualité de garde des Sceaux, ministre de la Justice, la commission des Lois a tenu, au cours de cette session, 98 réunions, siégeant durant plus de 160 heures et occupant 47% du temps de séance hors loi de finances et de financement de la sécurité sociale. Elle a examiné au fond 22 des 42 lois promulguées. Ce bilan prolonge les constats antérieurs. Depuis 2012, la Commission a examiné au fond 58 projets de loi et 94 propositions. Parmi ces textes, 83 ont été définitivement adoptés, dont 31 propositions de loi : l’initiative parlementaire occupe désormais une place incontestable, et la part réservée aux initiatives de l’opposition est réelle. À un an de la fin de la législature, le président de la commission des Lois a enfin souhaité mettre l’accent sur le contrôle de l’application des lois votées. Il ressort de ce travail que, s’agissant des lois de la XIVe législature relevant de la Commission et votées il y a plus de six mois, le taux d’application avoisine les 90% : quelques anomalies ont été relevées mais le résultat d’ensemble est très satisfaisant.

Placée à l’origine dans le pilier intergouvernemental, la politique migratoire de l’Union européenne est « communautarisée » par le traité d’Amsterdam à partir de 2004. Deux programmes quinquennaux s’échelonnant de 2004 à 2014 sont alors entrepris (La Haye 2004-2009 et Stockholm 2009-2014) dont l’objet essentiel consiste à renforcer le contrôle des frontières extérieures de l’Union européenne, tout en voulant préserver les droits fondamentaux reconnus aux migrants. Les objectifs définis dans le programme de La Haye sont désormais inscrits dans le traité sur le fonctionnement de l’Union européenne, entré en vigueur le 1er décembre 2009. Le Traité de Lisbonne mentionne dans son article 78 que l’Union « développe une politique commune en matière d’asile », selon la procédure habituelle de la codécision. Trois enjeux sont convoqués à cette réflexion européenne sur l’immigration : la protection des frontières, la pression migratoire et le respect des valeurs de l’Union européenne. Sur ces diverses bases, les Etats membres et l’Union européenne s’attachent, en principe, à réduire leurs divergences. Pourtant, les Etats continuent à mener des actions en ordre dispersé et à conserver des législations décalées. L’actualité demeure révélatrice d’une telle situation. Entre les milliers de naufragés économiques qui viennent échoir sur les côtes occidentales de la méditerranée et les réfugiés notamment moyen-orientaux qui lancent des cris de détresse, l’Union européenne offre une image de division. Chaque pays, selon des enjeux de politique interne, apporte des réponses variées. En outre, la notion d’immigrant est vectrice de confusion car selon la nature de l’immigration, un régime juridique spécifique se déclenche. Le demandeur d’asile n’est pas un migrant économique. Belgium has a unique place in the history of migration in that it was the first among industrialized nations in Continental Europe to develop into an immigrant society. In the nineteenth century Italians, Jews, Poles, Czechs, and North Africans settled in Belgium to work in industry and commerce. They were followed by Russians in the 1920s and Germans in the 1930s who were seeking a safe haven from persecution by totalitarian regimes. In the nineteenth century immigrants were to a larger extent integrated into Belgian society: they were denied political rights but participated on equal terms with Belgians in social life. This changed radically in the twentieth century; by 1940 the rights of aliens were severely curtailed, while those of Belgian citizens, in particular in the social domain, were extended. While the state evolved into a "welfare state" for its citizens it became more of a police state for immigrants. The state only tolerated immigrants who were prepared to carry out those jobs that were shunned by the Belgians. Under the pressure of public opinion, an exception was made in the cases of thousands of Jewish refugees that had fled from Nazi Germany. However, other immigrants were subjected to harsh regulations and in fact became the outcasts of twentieth-century Belgian liberal society. This remarkable study examines in depth and over a long time span how (anti-) alien policies were transformed, resulting in an illiberal exclusion of foreigners at the same time as democratization and the welfare state expanded. In this respect Belgium is certainly not unique but offers an interesting case study of developments that are characteristic for Europe as a whole.
