Parlare della trasparenza dal diritto di accesso documentale alla pubblicazione on-line, fino ad arrivare all'accessibilità totale, significa porsi in antitesi rispetto alla riservatezza dei dati contenuti nei documenti e nelle informazioni oggetto di pubblicazione obbligatoria da parte delle amministrazioni. Il bilanciamento della riservatezza e del diritto di accesso è necessario, come lo stesso Considerando n. 4 del Regolamento (UE) 2016/679 indica, prevedendo che «Il diritto alla protezione dei dati di carattere personale non è una prerogativa assoluta, ma va considerato alla luce della sua funzione sociale e va contemperato con altri diritti fondamentali, in ossequio al principio di proporzionalità». Questo breve testo approfondisce il tema relativo al "Bilanciamento tra trasparenza amministrativa e privacy nella Pubblica Amministrazione", dopo l'introduzione del Regolamento Generale per la Protezione dei Dati e il Codice privacy (Dlgs 196/2003) aggiornato con particolare attenzione all'applicazione degli enti locali.

Il lavoro tenta di delineare i tratti salienti di un significativo percorso di cambiamento già avviato, a suo tempo, con la legge delega 2012/190 e con il successivo D.Lgs. 2013/33, i quali hanno gettato le basi per una profonda rivisitazione del problematico rapporto tra Amministrazione e privato in termini di controllo sull’operato pubblicistico attraverso l’accessibilità ai dati ed alle informazioni. Si è, in buona sostanza, inaugurata una nuova fase volta a privilegiare, sia pure con delle evidenti sfumature, la logica della trasparenza, che si è prevalentemente articolata nel tempo in due rigorose accezioni: da un lato, alla stregua di strumento volto a garantire l’efficienza della Pubblica Amministrazione tramite la valorizzazione della performance dell’amministrazione e dei servizi pubblici nonché tramite una sorta di accessibilità totale all’agere pubblicistico; dall’altro, come un mezzo di prevenzione dei fenomeni corruttivi ampiamente diffusi nei settori nevralgici dell’operato pubblico attraverso il controllo degli iter procedimentali.

La codificazione degli obblighi di pubblicazione via web – operata dal decreto legislativo n. 33 del 2013 – semplifica il quadro normativo, ma rappresenta una sfida impegnativa per le amministrazioni. Il “Codice” della trasparenza amministrativa introduce, infatti, molte novità – il diritto a conoscere, l’accesso civico, la qualità dei dati, il diritto al riutilizzo, un nuovo equilibrio tra diffusione e tutela dei dati personali, la pubblicità sull’uso delle risorse – destinate a produrre un impatto significativo sul modo stesso di intendere ed organizzare i flussi informativi nelle amministrazioni pubbliche.
