During the last half of the twentieth century, legal philosophy (or legal theory or jurisprudence) has grown significantly. It is no longer the domain of a few isolated scholars in law and philosophy. Hundreds of scholars from diverse fields attend international meetings on the subject. In some universities, large lecture courses of five hundred students or more study it. The primary aim of the Law and Philosophy Library is to present some of the best original work on legal philosophy from both the Anglo-American and European traditions. Not only does it help make some of the best work avail able to an international audience, but it also encourages increased awareness of, and interaction between, the two major traditions. The primary focus is on full-length scholarly monographs, although some edited volumes of original papers are also included. The Library editors are assisted by an Editorial Advisory Board of internationally renowned scholars. Legal philosophy should not be considered a narrowly circumscribed field. Insights into law and legal institutions can come from diverse disciplines on a wide range of topics. Among the relevant disciplines or perspectives con tributing to legal philosophy, besides law and philosophy, are anthropology, economics, political science, and sociology. Ralph Wedgwood gives a general account of the concept of rationality. The Value of Rationality is designed as the first instalment of a trilogy - to be followed by accounts of the requirements of rationality that apply specifically to beliefs and choices. The central claim of the book is that rationality is a normative concept. This claim is defended against some recent objections. Normative concepts are to be explained in terms of values (not in terms of 'ought' or reasons). Rationality is itself a value: rational thinking is in a certain way better than irrational thinking. Specifically, rationality is an internalist concept: what it is rational for you to think now depends solely on what is now present in your mind. Nonetheless, rationality has an external goal - the goal of thinking correctly, or getting things right in one's thinking. The connection between thinking rationally and thinking correctly is probabilistic: if your thinking is irrational, that is in effect bad news about your thinking's degree of correctness. This account of rationality explains how we should set about giving a theory of what it is for beliefs and choices to be rational. Wedgwood thus unifies practical and theoretical rationality, and reveals the connections between formal accounts of rationality (such as those of formal epistemologists and decision theorists) and the more metaethics-inspired recent discussions of the normativity of rationality. He does so partly by drawing on recent work in the semantics of normative and modal terms (including deontic modals like 'ought').

Human actions unfold over time, in pursuit of ends that are not fully specified in advance. Rational Powers in Action locates these features of the human condition at the heart of a new theory of instrumental rationality. Where many theories of rational agency focus on instantaneous choices between sharply defined outcomes, treating the temporally extended and partially open-ended character of action as an afterthought, this book argues that the deep structure of instrumental rationality can only be understood if we see how it governs the pursuit of long-term, indeterminate ends. These are ends that cannot be realized through a single momentary action, and whose content leaves partly open what counts as realizing the end. Sergio Tenenbaum argues that we need to focus on temporal duration and the indeterminacy of ends in intentional action, even to explain the rational governance of relatively simple actions. Theories of moment-by-moment preference maximization, or indeed any understanding of instrumental rationality on the basis of momentary mental items, cannot capture the fundamental structure of our instrumentally rational capacities. Tenenbaum provides a new theory of instrumental rationality as rationality in action.

Scott Sturgeon presents an original account of mental states and their dynamics. He develops a detailed story of coarse- and fine-grained mental states, a novel perspective on how they fit together, an engaging theory of the rational transitions between them, and a fresh view of how formal methods can advance our understanding in this area. In doing so, he addresses a deep four-way divide in literature on epistemic rationality. Formal epistemology is done in specialized languages—often seeming a lot more like mathematics than Plato—and so can alienate philosophers who are drawn to more traditional work on thought experiments in epistemic rationality. Conversely, informal epistemology appears to be a lot more like Plato than mathematics and, as such, it tends to deter philosophers drawn to formal models of the phenomena. Similarly, the epistemology of coarse-grained states boils down everything to a discussion of rational belief—making the area appear a lot more like foundations of knowledge than anything useful for the theory rational decision, such as decision-making under uncertainty. The Rational Mind unifies work in all of these areas for the first time.
