At a time when Europe is growing together, cooperation between countries is becoming increasingly necessary. One of the main reasons for pursuing transnational spatial development is to attain a common understanding of the facts of spatial planning. Hence, the INTERREG III B project"COMMIN" sought to establish a common communication basis for the exchange of knowledge and experience in spatial planning and thus to foster and develop this understanding in the Baltic Sea region. Therefore, on the basis of a standardized structure the COMMIN project partners prepared basic information about institutional settings and spatial planning systems and compiled a glossary of key terminology in spatial planning accompanied by a varying range of fact sheets with respect to planning cases taken as examples. The readers will now find on www.commin.org the whole range of information covering the respective national languages as well as English translations, although in some countries official translations for these issues were lacking. The project partners were aware of the fact that each translation requires a balancing act between legal precision and communicable classification and, at the end, is a question of definition power and of different senses for semantics. The German text on hand (status December 2006) one information package out of eleven was prepared by a team comprising planners, lawyers, economists, and administrative academics. Actually no other publication treating this subject in English exists and it will hopefully contribute not only to understanding planning issues in Europe but also to transferring in this respect information and knowledge within the country. Anyway, being aware of differences between countries is a point of departure for the mutual understanding process.

The opening up, and subsequent tearing down, of the Berlin Wall in 1989 effectively ended a historically unique period for Europe that had drastically changed its face over a period of fifty years and redefined, in all sorts of ways, what was meant by East and West. For Germany in particular this radical change meant much more than unification of the divided country, although initially this process seemed to consume all of the country's energies and emotions. While the period of the Cold War saw the emergence of a Federal Republic distinctly Western in orientation, the coming down of the Iron Curtain meant that Germany's relationship with its traditional neighbours to the East and the South-East, which had been essentially frozen or redefined in different ways for the two German states by the Cold War, had to be rediscovered. This volume, which brings together scholars in German Studies from the United States, Germany and other European countries, examines the history of the relationship between Germany and Eastern Europe and the opportunities presented by the changes of the 1990's, drawing particular attention to the interaction between the willingness of German and its Eastern neighbours to work for political and economic inte-gration, on the one hand, and the cultural and social problems that stem from old prejudices and unresolved disputes left over from the Second World War, on the other.

Die Autorin befaßt sich mit einem der interessantesten Themen des neuen Raumordnungsrechts (ROG 1998): Den direkten Bindungswirkungen von Zielen und Grundsätzen der Raumordnung bei behördlichen Zulassungsentscheidungen über private Vorhaben.Während die Bindungswirkungen der Ziele und Grundsätze der Raumordnung früher im wesentlichen nur gegenüber öffentlichen Planungsträgern bestanden, erstrecken sie sich nunmehr in beachtlichem Umfang auch auf Privatrechtssubjekte. Im Mittelpunkt stehen die Vorschriften des § 4 Abs. l S. 2 Nr. 2 und Abs. 4, 5 ROG sowie die Raumordnungsklauseln des § 35 Abs. 3 S. 2, 3 BauGB.Die Verfasserin arbeitet heraus, daß Ziele der Raumordnung bei der Zulassung privater Vorhaben strikt verbindlich sein können, d. h. sowohl bei Planfeststellungsverfahren als auch bei der Genehmigung von Außenbereichsvorhaben. Insbesondere stünden dem auch keine verfassungsrechtlichen Gründe der Gesetzgebungskompetenz, des grundrechtlichen Eigentumsschutzes und des Gesetzesvorbehaltes entgegen. In den Landesplanungsgesetzen müsse de lege ferenda eine Bürgerbeteiligung für die Aufstellung grundrechtsbeeinträchtigender Ziele der Raumordnung vorgesehen werden, die nicht mit Ausnahmeregelungen versehen seien.Die raumordnerische Steuerung von raumbedeutsamen, privaten Großprojekten erfolgt vornehmlich durch Gebietsfestlegungen in Raumordnungsplänen in Form von Vorrang-, Vorbehalts- oder Eignungsgebieten (§ 7 Abs. 4 ROG). Diese Gebietskategorien werden eingehend analysiert. Die Verfasserin setzt sich im Zusammenhang mit der neuen Kategorie der Eignungsgebiete unter anderem auch mit der umstrittenen Problematik des Verbots der Negativplanung auseinander. Ein solches Verbot finde im Raumordnungsrecht - anders als im Städtebaurecht - keine Stütze.Durch die Darstellung am konkreten Beispiel der Kiesabgrabungen erhält die Dissertation ein hohes Maß an Anschaulichkeit. Sie verdient praktisch wie theoretisch gleichermaßen Aufmerksamkeit.
