Dieses Buch befasst sich mit der rechtlichen Bewertung von modernen Verfahren der Intervention in die menschliche Keimbahn, d.h. von gentechnischen Veränderungen am Menschen, die an die nachfolgenden Generationen weitergegeben werden. Neuartige Methoden wie die CRISPR/Cas9-Technik, der Mitochondrientransfer und die Möglichkeit der Herstellung artifizieller Gameten aus hiPS-Zellen stellen das Recht vor neue Herausforderungen. Insbesondere ist fraglich, ob die aktuell bestehenden Gesetze diese neuen Verfahren noch erfassen oder ob gesetzliche Lücken entstanden sind. Dieses Buch analysiert in diesem Zusammenhang die Rechtslage in Deutschland und Frankreich. Es behandelt dabei sowohl genetische Veränderungen an menschlichen Keimbahnzellen zur Forschung in vitro als auch solche, die in der Geburt von Menschen münden. Zudem wird der Frage nachgegangen, ob das deutsche Verfassungsrecht einer Anwendung dieser Verfahren grundsätzlich entgegensteht oder ob eine gesetzliche Zulassung in der Zukunft unter bestimmten Voraussetzungen möglich wäre. Auf der Grundlage des Rechtsvergleichs sowie der verfassungsrechtlichen Untersuchung formuliert das Buch einen Regelungsvorschlag, sowohl zur Beseitigung aktuell bestehender rechtlicher Lücken und Unklarheiten als auch im Hinblick auf eine (künftige) mögliche Anwendung der Verfahren.

The discovery of new biotechnological processes calls into question the ability of the law to provide sufficient protection for human beings from the beginning of their lite. These new methods, such as the CRISPR/Cas9 method -also known as "genome editing" -mitochondrial donation, and the creation of human induced pluripotent stem cells (hiPS cells), make it possible to manipulate and influence in a fundamental way the genetic make-up of one's offspring and future generations. This thesis aims to prepare a draft law addressed to the German legislature. ln so doing, it takes into account two aspects : on the one hand, it aims to optimise, on the basis of a comparative analysis of German and French law, current German legislation by identifying possible advantages of the regulatory approach in France. On the other hand - assuming that the techniques in question can one day be applied with controllable risks - it examines, on the basis of an analysis of German constitutional law, whether such a future application could, in principle, be justified and implements these considerations by drafting a legislative proposal.

The book provides a concise overview of currently applicable regulatory frameworks of states which are among the world leaders in research and development (R&D) of cell and gene therapies. Developments in genome editing are expected to lead to new possibilities for the treatment of hereditary diseases in humans. The treatment of such often severe but hitherto uncurable diseases can be based on genome-edited induced pluripotent stem cells (iPS cells). Such treatments constitute combined cell/gene therapies. These therapies need to be governed by a regulatory framework which ensures quality, safety, and efficacy of the relevant therapeutic products. On the other hand, such regulations may retard product approval and impede R&D. Accordingly, national regulations for therapies based on genome-edited iPS cells are an important and, as the case may be, decisive factor for both researchers and industry regarding their decision where to locate their R&D activities. Therefore, regulatory frameworks impact significantly on the competitiveness of states and their economies. This is why a comparative analysis of laws and regulations of different countries matters. Such a comparative legal analysis provides an important insight into regulatory concepts which, in turn, may inspire adjustments of, or amendments to, domestic legal regimes. For this purpose, experts present country reports on France, Germany, Japan, South Korea, Switzerland, and the USA. The reports on France and Germany also refer to the parameters and implications arising from pertinent EU law. This contributed volume is aimed at researchers, but also at, e.g., legal scholars, lawmakers, regulators, and political decision makers.

This volume elucidates the pivotal ethical and legal issues arising from the use of brain organoids for research, therapeutic and enhancement purposes. The function of the human brain is still a mystery. Until recently, only post-mortem tissue was available for a structural examination of the brain. Consequently, the examination results could only reflect the state at the end of life. However, in order to better understand the development and function of the human brain, dynamic and functional investigations of different human brain cells are necessary. This is where brain organoids, artificially grown in vitro miniature brains, provide the opportunity for more flexible research scenarios. At the same time, however, the use of brain organoids in research and therapy raises the question of how these new entities are to be treated from an ethical and legal point of view. Against this background, this volume aims at clarifying the normative implications of the use of brain organoids in research and therapy. The ethical reflections on the status of brain organoids, informed consent, human-to-animal chimeras and neuro-enhancement are mirrored by corresponding legal analyses. The ethical and legal assessments are preceded by an introduction to the scientific and medical background of the brain organoid technology. A final chapter will be devoted to the issue of whether international harmonization of normative standards for brain organoid research and therapy is feasible and advisable.

This book assembles essays by thinkers who were at the center of the German post World War II development of ethical thought in medicine. It records their strategies for overcoming initial resistance among physicians and philosophers and (in the East) politicians. This work traces their different approaches, such as socialist versus liberal bioethics; illustrates their attempt to introduce a culture of dialogue in medicine; and examines their moral ambiguities inherent to the institutionalization of bioethics and in law. The Braunschweigische Wissenschaftliche Gesellschaft (BWG) is a traditional scientific society, in which the interaction between natural and technical sciences and humanities is cultivated. The yearbook 2020 of the BWG provides an overview of the activities of the society, its research projects and lectures and scientific treatises by members and invited scientists. Die Sammlung von Fällen zum Medizinrecht richtet sich in erster Linie an Studierende der Rechtswissenschaften zur Vorbereitung auf Prüfungen im Schwerpunktstudium und Staatsexamen. Die ausgewählten Fälle und Lösungen weisen regelmäßig Bezüge zum klassischen Staatsexamens-Pflichtstoff auf, dienen doch auch die Schwerpunktbereiche der Ergänzung des Studiums und der Vertiefung der mit ihnen zusammenhängenden Pflichtfächer. Gerade das Medizinrecht, das alle großen und examensrelevanten Rechtsgebiete erfasst, erscheint als besonders geeignet für eine Art besonderes "Zwischenrepetitorium" vor der Staatsprüfung in den Pflichtfächern im 5. bis 7. Semester des rechtswissenschaftlichen Studiums. Darüber hinaus werden natürlich auch Rechtsgebiete angesprochen, die über den herkömmlichen Pflichtstoff in Juristischen Staatsprüfungen hinausreichen, also im engeren Sinne dem Schwerpunktstudium zuzurechnen sind. Die Fälle und Lösungen speisen sich in der Regel aus Entscheidungen der Rechtsprechung, die im rege nachgefragten Schwerpunktbereichsstudium Medizinrecht an der Juristischen Fakultät der Ludwig-Maximilians-Universität teils als fünfstündige Schwerpunkt-Examensklausuren gestellt, teils als Fälle besprochen worden sind. Das Medizinrecht als Querschnittsmaterie überschreitet die herkömmlichen Grenzen der "Säulen" von Zivil-, Straf- und Öffentlichem Recht und berührt obendrein nicht selten das (private wie gesetzliche) Krankenversicherungs- und Sozialversicherungsrecht. Diesem Charakter tragen die Fälle Rechnung. Wie in der Rechtswirklichkeit und dementsprechend auch im Schwerpunktexamen berühren sie typischerweise mehr als ein Rechtsgebiet, oft in Form von Verzahnungen.
