Eben diese Tatsache ist Anlass für die vorliegende Arbeit. „Zudem ist die Welle der Veränderung noch keineswegs ausgerollt. Lehr- und Erläuterungsbüchern, die älter als fünf Jahre sind, kommt heute kaum noch mehr als rechtsgeschichtliche Bedeutung zu.“ Einen identischen Begriff zu „Unbundling“ kennt der deutsche Wortschatz nicht, dennoch existieren zahlreiche Entsprechungen. Am ehesten treffen wohl die Synonyme „Entflechtung“ , „Entbündelung“ oder „Trennung“ zu. Unbundling im Energiesektor ist die Trennung der Monopol- und Wettbewerbsbereiche. Es handelt sich um eine Maßnahme, bei der die Wertschöpfungsstufen einer Unternehmung voneinander getrennt und in eigenständige Unternehmensbereiche überführt werden. Wie diese Trennung vollzogen werden kann, soll im Verlauf dieser Arbeit erläutert werden. Ursächlich für die Unbundling-Diskussion waren ursprünglich die Liberalisie-rungsbemühungen der EU, welche in den Jahren 1996 und 1998 in mehreren Sektoren eine Marktöffnung anstrebte, mit dem Ziel der Wettbewerbssteigerung und Effizienzerhöhung. Neben der Telekommunikations- und Postbranche trafen diese Bestrebungen auch den Energiesektor. Liberalisierung im Energiesektor, insbesondere auf dem Strommarkt, bedeutet Wettbewerb unter den Produzenten. Wettbewerb heißt, dass der Kunde seinen Anbieter selbständig wählen und zu ihm wechseln kann. Problematisch ist dabei, dass zwischen den Produzenten und den Kunden der Netzbetreiber steht. In der Regel sind die Energieversorgungsunternehmen neben ihrer Tätigkeit als Stromversorger, Inhaber des Netzes. Ein direkter Wettbewerb ist in einer solchen Situation unmöglich. Angesichts dieses Problems hat die EU-Kommission im Jahre 2003 zwei Beschleunigungsrichtlinien erlassen, welche in Deutschland derzeit in nationales Recht umgesetzt werden. Die EU schreibt den Energieversorgungsunternehmen darin die Umsetzung des Unbundling und somit die Ausgründung des Netzes vor und stellt sie damit vor große Herausforderungen.

Unbundling lässt sich wortwörtlich mit Entflechtung übersetzen. Exakt besagt dieser Ausdruck, dass Energieversorgungsunternehmen den Geschäftsbereich Netzbetrieb von den Wettbewerbsbereichen Erzeugung und Vertrieb trennen müssen. Im Rahmen der Entflechtung werden vier "Unbundlingbereiche" definiert. Neben der organisatorischen ist die rechtliche, informatorische und buchhalterische Trennung des Netzbetriebs im Energiewirtschaftsgesetz (EnWG) geregelt. Da diese vier Bereiche in einigen Punkten interdependent sind, werden neben der operationellen Entflechtung die anderen drei Bereiche in dieser Arbeit auch gewisse Rollen einnehmen. Die Arbeit gliedert sich wie folgt: Den Beginn bildet ein kurzer Abriss über die Entstehungsgeschichte des Energiewirtschaftsgesetzes. Dem folgt ein komprimierter Blick auf die aktuelle Rechtsgrundlage und auf die allgemeinen Ziele des EnWG. Danach werden die genauen Ziele der Entflechtung und deren Erfordernisse beschrieben. Hierbei erfolgt auch eine Erläuterung über die rechtliche und informatorische Trennung des Netzbetriebs und deren Zusammenhang mit der operationellen Entflechtung. Nach den Ausführungen der Anforderungen des Gesetzes, werden erste Reaktionen der Energieversorger, sowie eine mögliche Strategie der Umsetzung der Erfordernisse dargestellt. This book results from a pioneering effort to organize a productive interdisciplinary research program on sustainable development policy in a small country not previously recognized as a world leader in environmental social science. The results are very promising, considering the short time frame and the high barriers to success for such an enterprise - differences in concepts and terminology, disciplinary myopia, and the inherent difficulty of the problem. In the USA, where I work, these barriers continue to pose major challenges after some 30 years of effort. Switzerland has made noteworthy progress in only five. I hope this book represents the beginning of a long term effort at problem-oriented interdisciplinary collaboration among Swiss researchers and prac titioners. The Swiss group has succeeded in developing a unifying framework that makes a major contri bution to environmental policy analysis. The framework broadens policy thinking by giving se rious treatment to underutilized strategies that rely on communication and informal influence as well as to well-studied ones that rely on technological change, regulation, and economic forces. This broad typology makes it easier for an analyst to escape the tendency to presume that the po licy instrument currently in fashion, whether it be market-based instruments, voluntary measures, or whatever, is the right strategy for all problems.
