Der Vergleich verläuft dabei auf den Ebenen Gründung, Organe, Gesellschaftsvermögen, Besteuerung und Haftung. Abschließend wird auf die Auswirkungen des Brexits auf die Limiteds in Deutschland eingegangen. Es ist möglich, die Limited als alternative Gesellschaftsform zu der, in Deutschland am häufigsten gewählten, Gesellschaftsform, der GmbH zu betrachten. Grundlage hierfür war die Grundsatzrechtsprechung des europäischen Gerichtshofs in den Urteilen "Centros", "Überseering" und "Inspire Art", die klarstellten, dass europäische Gesellschaften in allen Ländern der Europäischen Union wegen ihrer Niederlassungsfreiheit anzuerkennen sind. Die britische Limited wirbt mit den wichtigsten Faktoren für den Mittelstand: eine schnelle und einfache Gründung, eine Haftungsbeschränkung und ein geringes Gründungskapital. Wie viele Limiteds es derzeit in Deutschland gibt, ist schwierig zu beziffern. Das englische Handelsregister, das Companies House, erfasst, die dort registrierten, Gründungen nicht nach der Staatangehörigkeit der Gründer und deren Absichten. Aus deutscher Sicht lässt sich auch keine genaue Zahl ermitteln, da nicht davon auszugehen ist, dass alle in Deutschland tätigen Limiteds eine deutsche Zweigniederlassung oder Betriebsstätte angemeldet haben. Bei einer Abfrage über das gemeinsame Registerportal der Länder erschienen 4.615 Treffer bei der Suchanfrage „Limited“ in der Firma. Weitere 4.129 Treffer ergab die Suchanfrage mit dem Unternehmenszusatz „Ltd.“ Die Anzahl der GmbHs in Deutschland beläuft sich auf 1,15 Millionen und ist damit die häufigste Rechtsform in Deutschland.

This third volume in a series on Comparative Succession Law concerns the entitlement of family members to override the provisions of a deceased person's will to obtain money or assets (or more money or assets) from the person's estate. Some countries, notably those in the civil law tradition (such as France or Germany), confer a pre-ordained share of the deceased's estate or of its value on certain members of the deceased's family, and especially on the deceased's children and spouse. Other countries, notably those in the common law tradition (such as England, Canada, or Australia), leave the matter to the discretion of the court, the amount awarded depending primarily on financial need. Whichever form it takes, mandatory family provision is both a protection against disinheritance and also, therefore, a restriction on testamentary freedom. The volume focuses on Europe and on countries influenced by the European experience.
