In the United States today criminal justice can vary from state to state, as various states alter the Modern Penal Code to suit their own local preferences and concerns. In Eastern Europe, the post-Communist countries are quickly adopting new criminal codes to reflect their specific national concerns as they gain autonomy from what was once a centralized Soviet policy. As commonalities among countries and states disintegrate, how are we to view the basic concepts of criminal law as a whole? Eminent legal scholar George Fletcher acknowledges that criminal law is becoming increasingly localized, with every country and state adopting their own conception of punishable behavior, determining their own definitions of offenses. Yet by taking a step back from the details and linguistic variations of the criminal codes, Fletcher is able to perceive an underlying unity among diverse systems of criminal justice. Crime and the Administration of Justice in Buenos Aires, 1785-1853, analyzes the emergence of the criminal justice system in modern Argentina, focusing on the city of Buenos Aires as a case study. It concentrates on the formative period of the postcolonial penal system, from the installation of the second Audiencia (the superior justice tribunal in the viceroyalty of Río de la Plata) in 1785 to the promulgation of the Argentine national constitution in 1853, when a new phase of interregional organization and codification began. Through analysis of criminal cases, Barreneche shows how different interpretations of liberalism, the changing roles of the new police and the military, and the institutionalization of education all contributed to the debate on penal reform during Argentina's transition from colony to state. "El Derecho penal de hoy es un Derecho público, normativo, valorativo y finalista que tiene la norma y el bien jurídico como polos de su eje y cuya naturaleza es eminentemente sancionadora. El Derecho penal de hoy es un Derecho público, porque sólo el Estado es capaz de crear normas que definan delitos y que impongan sanciones en holocausto al apotegma liberal nullum crimen, nulla poena sine lege. El Derecho disciplinario, que una sociedad puede aplicar a los miembros que la forman, nada tiene que ver con el Derecho penal de carácter público, y por eso, al fijar el “tipo”, puede permitirse la vaguedad que le está prohibida al legislador en sus Códigos.
