The legal framework for internal controls is an important part of prudential regulation, and internal control also constitutes a form of internal gate-keeping for financial firms so that compliance with laws and regulations can be secured. This book argues that the legal framework for internal control, which is a form of meta-regulation, is susceptible to weaknesses, and such weaknesses are critically examined by adopting an interdisciplinary approach. Ten years have passed since the Mental Health Act (MHA) 2007 came into force in England. An amending statute, the Act reformed the MHA 1983 and reshaped the law governing the compulsory care and treatment of people suffering from mental disorders. Primarily driven by concerns about risk, it sought to remove legalistic obstacles to civil commitment and extend the law's coercive reach into the community. At the time of its introduction, the 2007 Act was written off as a retrograde step and a missed opportunity for radical, rights-focused reform. Despite this, little attention has been paid to its impact in the years since. Published to coincide with the tenth anniversary of the 2007 Act, this book offers a timely evaluation of mental health law and policy in England. It argues that the current MHA defies easy categorisation within any of the descriptive models which have customarily narrated the mechanics of civil commitment, namely 'legalism', 'new legalism', and 'medicalism'. It therefore makes the case for a new model – new medicalism – to account for the 2007 Act's enhancement of the discretion of mental health professionals for the express purposes of facilitating the management of situations of risk. In doing so, the book: critically examines the problems inherent in civil commitment frameworks organised around the concept of risk; explores the theoretical foundations of new medicalism; considers the challenges facing proponents of future reform in the era of the UN Convention on the Rights of Persons with Disabilities; and, reflects on the 2007 Act's practical impact.

Cate demonstrates that rather than a panacea, community-based juvenile justice reforms have resulted in a dangerous constellation of privatized institutions with little oversight. This book proposes a simple framework for understanding the political economy of subsidy reform andapplies it to four in-depth country studies covering more than 30 distinct episodes of reform.Five key lessons emerge. First, energy subsidies often follow a life cycle, beginning as a way to stabilize pricesand reduce exposure to price volatility for low-income consumers. However, as they grow in size and politicalpower, they become entrenched. Second, subsidy reform strategies vary because the underlying politicaleconomy problems vary. When benefits are concentrated, satisfying (or isolating) interest groups withalternative policies is an important condition for effective reform. When benefits are diffuse, it can be muchharder to identify and manage the political coalition needed for reform. Third, governments vary in theiradministrative and political capacities to implement difficult energy subsidy reforms. Fourth, improvementsin social protection systems are often critical to the success of reforms because they make it possible totarget assistance to those most in need. Finally, the most interesting cases involve governments that take astrategic approach to the challenges of political economy. In these settings, fixing energy subsidies is centralto the governments’ missions of retaining political power and reorganizing how the government deliversbenefits to the population. These cases are examples of “reform engineering,” where governments activelyseek to create the capacity to implement alternative policies, depoliticize tariffs, and build credibility aroundalternative policies.The most successful reforms involve active efforts by policy leaders to identify the political forces supportingenergy subsidies and redirect or inoculate them.
