This book critically interrogates the principle of asylum for refugees in UK law and proposes that, when faced with the migration of non-European refugee groups, this principle has often been limited. The book considers the response of the State to the migration of various groups of refugees through five centuries. The reaction of the legal system to the arrival of gypsies and Huguenots from the Gudor period is analysed. The responses to the arrival of African refugees from the American War of Independence is also considered here, along with an examination of the reactions to refugees from the French Revolution and the Napoleonic Wars; various European refugee groups in the mid-Victorian period; Jews from Eastern Europe and later from Nazism; and groups displaced in Europe as a result of the Second World War. Refugees, Race and the Legal Concept of Asylum in Britain also provides a detailed discussion of the backlash against African and Asian refugee groups, in particular, as against the East African Asians, Vietnamese and Tamils from Sri Lanka. An analysis of the major legislative reforms of the 1990s which have been directed against the settlement of Asian and African refugees is also presented. The post-Second World War period is scrutinised in the context of the failure of European human rights law and international norms of refugee protection to secure the principle of asylum, and the implications of the development of a 'Fortress Europe' that is premised on the tight control of non-European migrants are drawn out.

This book is the first to focus specifically upon the relationship between refugees and intercultural transfer over an extensive period of time. Since circa 1830, a series of groups have made their way to Britain, beginning with exiles from the failed European revolutions of the mid-nineteenth century and ending with refugees who have increasingly come from beyond Europe. The book addresses four specific questions. First, what roles have individuals or groups of refugees played in cultural and political transfers to Britain since 1830? Second, can we identify a novel form of cultural production which differs from that in the homeland? Third, to what extent has dissemination within and transformation of the receiving culture occurred? Fourth, to what extent do refugee groups, themselves, undergo a process of cultural restructuring? The coverage of the individual essays ranges from high culture, through politics and everyday practices. The volume moves away from general perceptions of refugees as ‘problem groups’ and rather focuses on the way they have shaped, and indeed enriched, British cultural and political life. This book investigates the hostile environment and politics of visceral and racial denigration which have characterised responses to refugees and migrants within the UK and Europe in recent years. The European ‘migrant crisis’ from 2015 onwards has been characterised by an extremely intimidating atmosphere which denies the basic humanity of refugees and migrants. Deep rooted in Western Enlightenment trajectory, this racially-driven politics is linked to the Western theories of scientific superiority which went on to become the basis of eugenics and coloniality as part of modernity. Focusing on the ‘migrant crisis’, Brexit, and the impacts of the global pandemic, this book unpicks the waves of crises and neuroses about the ‘Other’ in Europe and the UK. The chapters analyse the rhetoric of camps, refrigerated death lorries, the notion of channel crossings and ‘accidental’ drownings, the formation of relationship with border architecture such as the razor wire, and corporeal resistance in detention centres through hunger strike. In examining such specific sites of rhetorical articulation, policy formation, social imagination, and its incumbent visuality, the chapters deconstruct the intersection of dominant ideologies, power, knowledge paradigms (including the media) as part of the public sphere and their combined re-mediation of the dispossessed humans in the shores and borders of Europe.
