A 10.a edição e a imediata esgotaram-se antes do prazo previsto. Era natural seguirem-se-lhes meras reimpressões. Todavia, vim anotando nos meus exemplares de trabalho múltiplas e significativas alterações de vária ordem. Deste modo, o livro regressaria a público desactualizado, em desacordo com o que tem sucedido. Optei, assim, por reformulações, onde se incluíram, conservando o mais possível a paginação, as mudanças sucessivas que pareceram de maior relevo na perspectiva do direito das obrigações. As fichas técnicas marcam, respectivamente, os limites temporais de 31 de Março de 2008 e de 15 de Outubro de 2009. Eis o quadro em que surge agora a 12.a edição, também ultimada rapidamente e sobreposta a outros projectos. Ainda encontrei ânimo e perseverança para uma revisão empenhada que acompanhasse as constantes e amiúde surpreendentes reformas legislativas, incluindo crescentes e não raro mal-amadas transposições comunitárias, a linha da construção dogmática, os rumos jurisprudenciais e a produção bibliográfica. Como regra, remete-se para a última versão conhecida. Todas as apreensões confessadas em Nota Prévia à 10.a Edição se confirmaram e até avolumaram. Não superei por completo as dúvidas e incertezas que me surgiram como frágil nauta de tão revolto oceano jurídico-cientifico e prático. Simplesmente, pretendi, de novo, cumprir o que estava ao meu alcance, embora nunca esquecendo que os livros jurídicos, enquanto assentes no direito positivo, lembram, cada vez mais, os escritos em areia ao vento. Originally published thirty years ago, Critique of the Legal Order remains highly relevant for the twenty-first century. Here Richard Quinney provides a critical look at the legal order in capitalist society. Using a traditional Marxist perspective, he argues that the legal order is not intended to reduce crime and suffering, but to maintain class differences and a social order that mainly benefits the ruling class. Quinney challenges modern criminologists to examine their own positions. As "ancillary agents of power," criminologists provide information that governing elites use to manipulate and control those who threaten the system. Quinney's original and thorough analysis of "crime control bureaucracies" and the class basis of such bureaucracies anticipates subsequent research and theorizing about the "crime control industry," a system that aims at social control of marginalized populations, rather than elimination of the social conditions that give rise to crime. He forcefully argues that technology applied to a "war against crime," together with academic scholarship, is used to help maintain social order to benefit a ruling class. Quinney also suggests alternatives. Anticipating the work of Noam Chomsky, he suggests we must first overcome a powerful media that provides a "general framework" that serves as the "boundary of expression." Chomsky calls this the manufacture of consent by providing necessary illusions. Quinney calls for a critical philosophy that enables us to transcend the current order and seek an egalitarian socialist order based upon true democratic principles. This core study for criminologists should interest those with a critical perspective on contemporary society.

The majority of citizens in the world today do not trust their political representatives, the mainstream political parties, the established political institutions or their governments. This widespread crisis of legitimacy underlies a series of dramatic changes that have taken place in recent times in the global political landscape, such as the unexpected election of Donald Trump, Brexit, the demise of traditional political parties and the election of a political outsider in France, the transformation of the political system in Spain (including the secessionist movement in Catalonia), the rise of the extreme right in Europe and the nationalist challenges that threaten the European Union. In this short but wide-ranging book Manuel Castells analyses each of these processes and examines some of the potential causes of people’s disaffection towards the institutions of liberal democracy, including the effects of globalization, the impact of media politics and the internet, the increasing corruption of politicians, the insulation of a professional political class from civil society and the critique of the existing order by new social movements. He also examines the impact of global terrorism and war on the xenophobia and racism that are fuelling the surge of extremism among a growing proportion of the population. The fact that many of these trends are present in very different contexts suggests that we are witnessing a deep-seated crisis of the model of democracy that has been the cornerstone of stability and civility in the last half century.
