Ampio spazio è dedicato, in particolare, alla determinazione dell’entità e al pagamento dell’indennità di espropriazione, al suo regime fiscale ed alle imposte indirette sugli atti della procedura ablatoria, al fenomeno dell’occupazione acquisitiva e usurpativa, nonché ai delicati temi della giurisdizione e della pregiudiziale amministrativa sui quali si è registrato uno scontro senza precedenti tra la Suprema Corte di Cassazione e il Consiglio di Stato. Vasta, pertanto, è la giurisprudenza citata poiché da questa non può prescindersi per comprendere, attraverso la sua evoluzione, i principi generali che governano l’espropriazione. L’istituto, nonostante l’entrata in vigore, a decorrere dal 30 giugno 2003, del Testo Unico approvato con il d.P.R. 8 giugno 2001, n. 327, è comunque in continua evoluzione. Di recente la sentenza della Corte Costituzionale dell’8 ottobre 2010, n. 293, ha dichiarato l’illegittimità costituzionale dell’intero articolo 43 del Testo Unico, il quale attribuiva all’Amministrazione la facoltà di emanare un provvedimento postumo di acquisizione coattiva del bene, così sanando ogni forma di pregressa illegittimità. Il venir meno di questa facoltà ha aperto, infatti, nuove problematiche riguardanti le sorti dei terreni occupati senza titolo dalla Pubblica Amministrazione, sui quali la realizzazione dell’opera pubblica è ormai giunta a compimento. Il testo offre già una prima risposta a questo interrogativo e dà conto nella Prefazione delle prime pronunce intervenute tra la fine del 2010 e l’inizio del 2011 sullo scottante argomento.
