O princípio da não discriminação é pedra angular de um Estado Democrático de Direito, encontrando eco quer no plano constitucional brasileiro, quer nos compromissos internacionais firmados pelo Brasil. No mundo do trabalho, manifesta-se sob diversos prismas, como: na vedação à distinção entre trabalhos manuais, técnicos e intelectuais; na garantia de igualdade salarial entre trabalhadores com iguais funções; na garantia de igualdade de tratamento entre homens e mulheres. O pano de fundo da presente edição é tratar da isonomia entre homens e mulheres. A escolha de tal temática se deu em virtude de que, a despeito do avanço democrático e igualitário promovido pela Constituição Federal de 1988 e de todas as conquistas que foram obtidas ao largo das últimas décadas pelo movimento feminista, ainda persiste candente na sociedade brasileira uma estrutura social patriarcal que discrimina e oprime as mulheres em diversos aspectos da vida, mantendo-as em uma situação de subordinação e inferioridade. Desigualdades estruturais, divisão sexual do trabalho, estereótipos de gênero e violência, permeiam as entranhas da sociedade brasileira, repercutindo em todas as esferas da vivência humana. As relações laborais, marcadas pelo poder diretivo patronal e, consequentemente, desiguais, são campo fértil para que as discriminações de gênero se manifestem. Com efeito, mesmo diante do vasto arcabouço normativo que se ocupa da isonomia, ainda se verificam no dia a dia forense incontáveis casos de mulheres que enfrentam discriminação e desigualdades que afetam suas oportunidades e condições de trabalho. Superar este estado de coisas não é tarefa fácil. É nesse contexto que a perspectiva de gênero nos julgamentos se torna essencial para promover a justiça e a igualdade no ambiente profissional. Julgamento com perspectiva de gênero significa considerar as diferentes realidades e experiências vividas por homens e mulheres no trabalho, levando em conta questões como salários desiguais, assédio sexual, falta de oportunidades de contratação e/ou promoção, proteção à maternidade e outros desafios que afetam especialmente as mulheres. É um olhar crítico e sensível que busca corrigir as desigualdades e promover a inclusão. Julgar com perspectiva de gênero implica em envolvimento com o litígio, compreendendo as assimetrias de gênero subjacentes às relações sociais e laborais. É fundamental, portanto, que os juízes e juízas, assim como os demais operadores do direito, estejam sensibilizados para a importância da perspectiva de gênero e capacitados para aplicá-la em suas decisões, o que sobreleva a importância desta Edição, em que a ANAMATRA reafirma seu compromisso com o Estado Democrático de Direitos e a defesa do Direito do Trabalho como ferramenta civilizatória e de promoção da dignidade.

This volume addresses the pluralistic identity of the legal order. It argues that the mutual reflexivity of the different ways society perceives law and law perceives society eclipses the unique formal identity of written law. It advances a distinctive approach to the plural ways in which legal cultures work in a modern society, through the metaphor of the mirror. As a mirror of society, it distinguishes between the structure and function of legal culture within the legal system, and the external representation of law in society. This duality is further problematized in relation to the increasing transnationalisation of law. Based on a multi-level interpretation of the concept of legal culture, the work is divided into three parts: the first addresses the mutual reflections of social and legal norms that support a pluralist representation of internal legal cultures, the second concentrates on the external legal cultures that constantly enable pragmatic adjustments of the legal order to its social environment, and the third concludes the book with a theoretical discussion of the issues presented.

Gamboa's World examines the changing legal landscape of eighteenth-century Mexico through the lens of the jurist Francisco Xavier de Gamboa (1717-1794). Gamboa was both a representative of legal professionals in the Spanish world and a central protagonist in major legal controversies in Mexico. Of Basque descent, Gamboa rose from an impoverished childhood in Guadalajara to the top of the judicial hierarchy in New Spain. He practiced law in Mexico City in the 1740s, represented Mexican merchants in Madrid in the late 1750s, published an authoritative commentary on mining law in 1761, and served for three decades as an Audiencia magistrate. In 1788 he became the first locally born regent, or chief justice, of the High Court of New Spain. In this important work, Christopher Albi shows how Gamboa's forgotten career path illuminates the evolution of colonial legal culture and how his arguments about law and justice remain relevant today as Mexico debates how to strengthen the rule of law.

Norms beyond Empire seeks to rethink the relationship between law and empire by emphasizing the role of local normative production. While European imperialism is often viewed as being able to shape colonial law and government to its image, this volume argues that early modern empires could never monolithically control how these processes unfolded. Examining the Iberian empires in Asia, it seeks to look at norms as a means of escaping the often too narrow concept of law and look beyond empire to highlight the ways in which law-making and local normativities frequently acted beyond colonial rule. The ten chapters explore normative production from this perspective by focusing on case studies from China, India, Japan, and the Philippines.
