Constitutionalism And The Paradox Of Principles And Rules written by Marcelo Neves and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2021-04-29 with Law categories.

This title offers a unique approach to constitutionalism, focusing on the paradoxical relationship between principles and rules from the perspective of systems theory. It presents a critical counterpoint to Ronald Dworkin's principle-based theory, and in particular to Robert Alexy's idea of optimizing balancing. Instead of ceding to the compulsion of an optimizing balancing, it suggests the possibility of a comparative or at least 'satisficing' balancing, considering the precariousness of legal rationality. The book also reverses Dworkin's metaphor, associating rules with Hercules and principles with the Hydra. It takes constitutional principles seriously, criticizing the abuse of principles by the legal and constitutional doctrine and practice, and pointing out their relationship of complementarity and tension with rules. Finally, it offers an alternative model to the recent legal and constitutional theory on the basis of certain assumptions of the systems theory. It deals especially with the paradox of the circular and reflexive relationship between constitutional principles and rules: the former refers primarily to the openness and adequacy of legal system to society and thus to substantive argumentation; the second refers primarily to the closure and consistency of legal system and thus to formal argumentation.

Latin eugenics was a scientific, cultural and political programme designed to biologically empower modern European and American nations once commonly described as 'Latin', sharing genealogical, linguistic, religious, and cultural origins. Latin Eugenics in Comparative Perspective offers a comparative, nuanced approach to eugenics as a scientific programme as well as a cultural and political phenomenon. It examines the commonalities of eugenics in 'Latin' Europe and Latin America. As a program to achieve the social and political goals of modern welfare systems, Latin eugenics strongly influenced the complex relationship of the state to the individual. Drawing on a wide range of primary and secondary sources in many languages, this book offers the first history of Latin eugenics in Europe and the Americas.

Measuring Intra Party Democracy written by Benjamin von dem Berge and has been published by Springer Science & Business Media this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-03-12 with Political Science categories.

This book presents an integrated approach to measuring the level of intra-party democracy through deductive and standardized content analysis of party statutes. Following the two main criteria of intra-party democracy – inclusiveness and decentralization – three main categories of intra-party democracy are theoretically derived: members’ rights, organizational structure and decision-making. On the basis of theoretical considerations further sub-categories and individual items are deduced from these main categories and put together into a comprehensive coding scheme. Furthermore, precise coding instructions are presented. Since it is the ultimate aim of this book to present an approach to measuring the level of intra-party democracy for any party statute and to express this in numerical terms, the final step is the quantification of the coded data and the calculation of a numeric measure of intra-party democracy. A numeric value of intra-party democracy can be calculated for any statute of any political party. Furthermore, empirical examples from Hungary, Slovakia and Romania are presented.

Constitutionalism Of The Global South written by Daniel Bonilla Maldonado and has been published by Cambridge University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-04-18 with Law categories.

The Indian Supreme Court, the South African Constitutional Court and the Colombian Constitutional Court have been among the most important and creative courts in the Global South. In Asia, Africa and Latin America, they are seen as activist tribunals that have contributed (or attempted to contribute) to the structural transformation of the public and private spheres of their countries. The cases issued by these courts are creating a constitutionalism of the Global South. This book addresses in a direct and detailed way the jurisprudence of these Courts on three key topics: access to justice, cultural diversity and socioeconomic rights. This volume is a valuable contribution to the discussion about the contours and structure of contemporary constitutionalism. It makes explicit that this discussion has interlocutors both in the Global South and Global North while showing the common discourse between them and the differences on how they interpret and solve key constitutional problems.

Dependency And Development In Latin America written by Fernando Henrique Cardoso and has been published by Univ of California Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2024-03-29 with History categories.

At the end of World War II, several Latin American countries seemed to be ready for industrialization and self-sustaining economic growth. Instead, they found that they had exchanged old forms of political and economic dependence for a new kind of dependency on the international capitalism of multinational corporations. In the much-acclaimed original Spanish edition (Dependencia y Desarrollo en América Latina) and now in the expanded and revised English version, Cardoso and Faletto offer a sophisticated analysis of the economic development of Latin America. The economic dependency of Latin America stems not merely from the domination of the world market over internal national and "enclave" economies, but also from the much more complex interact ion of economic drives, political structures, social movements, and historically conditioned alliances. While heeding the unique histories of individual nations, the authors discern four general stages in Latin America's economic development: the early outward expansion of newly independent nations, the political emergence of the middle sector, the formation of internal markets in response to population growth, and the new dependence on international markets. In a postscript for this edition, Cardoso and Faletto examine the political, social and economic changes of the past ten years in light of their original hypotheses.
