En choisissant de traiter la place du droit pénal dans la société contemporaine, les auteurs de cet ouvrage (professeurs et magistrats) ont voulu présenter un bilan qui ne serait placé ni sous le signe d'une " crise " ni sous l'accusation d'un " dévoiement " du droit pénal. L'hypothèse de départ est plutôt celle d'un éclatement suivi d'une recomposition du droit pénal. Cet éclatement est analysé par secteurs thématiques (droit pénal des sociétés, droit pénal du travail, droit pénal des médias, droit pénal de la bioéthique et droit pénal des mineurs), mais il fait aussi l'objet d'une étude dans l'espace géographique qu'il s'agisse de la place croissante du droit pénal dans l'Union européenne ou au sein des relations internationales. Quant à la recomposition elle est envisagée à travers le rôle fédérateur des droits de l'homme, consacré en droit international par l'influence de la Convention européenne des droits de l'homme. Sans oublier le rôle propre des parlementaires et du Parlement et sans négliger l'éthique politique désormais mise à l'épreuve du droit pénal. Corrélativement une place essentielle devrait être réservée à l'enseignement du droit pénal, même si la réalité révèle paradoxalement une certaine marginalisation. En somme cet ensemble de contributions invite à prendre conscience des contradictions qui traversent à l'heure actuelle le droit pénal. Ces contradictions sont d'abord d'ordre politique, dès lors que l'internationalisation du droit pénal apparaît inéluctable, malgré l'attachement des Etats au monopole du droit de punir, symbole de la souveraineté nationale. Elles sont aussi d'ordre juridique, tant la relation reste ambiguë entre le droit pénal et les autres branches du droit. Et ce n'est pas la moindre des contradictions que de constater que la dépénalisation participe à la promotion des principes issus du droit pénal en un droit commun du contrôle social. Les études réunies dans cet ouvrage sont également publiées dans le numéro 1 (2000) de la " Revue de science criminelle et de droit pénal comparé ".

In 1994 the School of Criminology, a part of the Department of Criminal Law, Criminal Procedure and Criminology in the Faculty of Law of the Katholieke Universiteit Leuven, celebrated the 25th anniversary of its study programme. To give added lustre to this landmark in its history, the Institute accepted the invitation from the International Society of Criminology to organise the 49th International Course of Criminology. The title of the course was: Changes in Society, Crime and Criminal Justice in Europe. A challenge for criminological education and research'. This course explored two themes, both of which are likely to be the focus of debate in criminal policy in the near future: crime and insecurity in the city, and international organised and corporate crime. The presentation and discussion of both themes followed two main approaches. Lectures and seminars focused on the analysis of the nature, the quantity and the development of the phenomena, and meetings were focused on the policy needed to gain control of these phenomena. Moreover, attention was paid to technical and ethical problems which show up at the moment that empirical research is carried out. This publication brings together the main part of the introductory lectures. Part one relates to the theme of crime and insecurity in the city; the second part contains the lectures on international organised and corporate crime. Together both parts present a good picture of what was explained and commented on during the Course, especially in relation to important European developments concerning crime, criminal justice and criminal policy. This book will become an important source of inspiration for both criminological educationand research.
