La valenza probatoria del documento si contrappone a quella della prova testimoniale rispetto alla quale offre alcuni innegabili vantaggi: la durata nel tempo del mezzo di prova (normalmente il documento scritto sopravvive più a lungo della persona del testimone); una più facile disponibilità ed economicità dello stesso (quando, in particolare, sarebbe necessario far giungere il teste da luoghi lontani); una maggiore oggettività e stabilità del suo oggetto una volta fissato su un supporto (rispetto alla mutevole soggettività che sempre contraddistingue le deposizioni testimoniali). Di contro, il documento scritto non è esente da profili che ne hanno a lungo ostacolato la piena affermazione nell’uso dei privati. In particolare – oltre a presupporre società con elevata alfabetizzazione – il documento si presta ad essere facilmente falsificato. Garantire a un tempo l’affidabilità del documento e la possibilità di opporsi efficacemente all’uso giudiziale di documenti di cui si sospetta la falsità è dunque un tema centrale, oggi come nel passato, quando si vuole che il processo raggiunga l’obiettivo primario di accertamento dei fatti giuridici. A tale tema Pasqualina Farina ha dedicato le sue ricerche. In questo primo volume si ripercorrono criticamente le alterne soluzioni che si sono via via sperimentate dall’antichità romana sino ai codici unitari.

Emilio Betti dedicò ai temi del diritto processuale civile una parte importante della sua lunga e intensa attività di studioso. Ai ‘misteri’ del processo si accostò sia come ‘romanista’ sia come giurista positivo. Scrisse note a sentenza, saggi, voluminose monografie e persino un vero e proprio manuale (allo studio del processo, lo studioso camerte affiancò, infatti, anche l’insegnamento della procedura civile italiana in vari dei molti atenei in cui gli capitò di lavorare). Betti non fu dunque un semplice ‘processualista di complemento. Se dunque il giurista di Camerino fu un autentico ‘processualista’, in che misura le sue riflessioni possono ancora oggi dirsi significative, attuali, utili? A rispondere a queste domande sono stati chiamati studiosi di diversa provenienza scientifica (‘romanisti’, storici del diritto e, naturalmente, processualisti). L’attenzione è stata via via concentrata su vari dei molteplici argomenti toccati dallo studioso camerte in materia di diritto processuale. Il lettore avrà così modo di verificare che il lascito di Emilio Betti alla storia del processo antico e, più in generale, alla disciplina processualistica mantiene tuttora una valenza assai grande.
