Criminal responsibility is now central to criminal law, but it is in need of re-examination. In the context of Australian criminal laws, Self, Others and the State reassesses the general assumptions made about the rise to prominence of criminal responsibility in the period since around the turn of the twentieth century. It reconsiders the role of criminal responsibility in criminal law, arguing that criminal responsibility is significant because it organises key sets of relations - between self, others and the state - as relations of responsibility. Detailed studies of decisive moments and developments since the turn of the twentieth century, and original explorations of relations of responsibility, expose the complexity and dynamism of criminal responsibility and reveal that it is the means by which matters of subjectivity, relationality and power make themselves felt in the criminal law.

While an abundance of literature covers the right of states to defend themselves against external aggression, this is the first book dedicated to the right to personal self-defense in international law. Drawing on his extensive experience as a human rights practitioner and scholar, Dr. Hessbruegge sets out in careful detail the strict requirements that human rights impose on defensive force by law enforcement authorities, especially police killings in self-defense. The book also discusses the exceptional application of the right to personal self-defense in military-led operations, notably to contain violent civilians who do not directly participate in hostilities. Human rights also establish parameters on how broad or narrow the laws can be drawn on self-defense between private persons. Setting out the prevailing international standards, the book critically examines the ongoing trend to excessively broaden self-defense laws. It also refutes the claim that there is a human right to possess firearms for self-defense purposes. In extraordinary circumstances, the right to personal self-defence sharpens human rights and allows people to defend themselves against the state. Here the author establishes that international law gives individuals the right to forcibly resist human rights violations that pose a serious risk of significant and irreparable harm. At the same time, he calls into question prevailing state practice, which fails to recognize any collective right to organized armed resistance even when it constitutes the last resort to defend against genocide or other mass atrocities.

In the past two decades there has been considerable interest in the ways in which subjects are positioned in discursive practice. This interest has entailed a focus on the role of language and discourse in the processes in and through which subjects are constituted in discourse. However, questions of agency and how it relates to consciousness have received less attention. This book explores the ways in which agency and consciousness are created through transactions between self and other. The book argues that it is necessary to regard body-brain interactions in the context of the social and discursive practices which act upon human bodies. These issues of agency and individuation are explored in relation to infant semiosis, as well as in relation to children's symbolic play. Thibault looks at the importance of the self-referential moral conscience in relation to the interpersonal dimension of all acts of meaning-making. This conscience is also connected to the development of a self-referential viewpoint which the book argues is connected to the ecosocial semiotic systems of thinking about consciousness as a complex system operating on many different levels. What do we owe to each other simply out of respect, or concern, for our common humanity? What can we claim? The United Nations' Sustainable Development Goals and the Universal Declaration of Human Rights as well as many states' constitutions embody competing answers to these questions. Different accounts of what we owe to others out of concern for our common humanity ground divergent accounts of the basic minimum just societies and the international community must help people secure. A Minimally Good Life argues that concern for our common humanity requires helping others live minimally good lives when doing so does not require sacrificing our own ability to live well enough. This, it suggests, provides a unified answer to the question of what we must give to, and can demand from, others as a basic minimum. More precisely, Nicole Hassoun argues that people must obtain the things that let them secure the relationships, pleasures, knowledge, appreciation, worthwhile activities, and other things that a reasonable and caring person free from coercion and constraint would set as a minimal standard of justifiable aspiration. That is, as reasonable, caring, free people, we should put ourselves into each other's shoes and think about what we need to live well enough as each person. Hassoun makes this case by engaging with the main competitors in the literature: those that offer different accounts of the basic minimum and the limits of our obligations. She then defends a new way of helping people in present and future generations reach the sufficiency threshold and of responding to apparent tragedy when helping everyone seems impossible.
