Furono gli illuministi per primi a ridefinire un'etica dei diritti cosmopolita, razionale, mite, umanitaria, fatta dall'uomo per l'uomo, capace di dar vita a un potente linguaggio politico dei moderni contro il secolare Antico regime dei privilegi, delle gerarchie, della disuguaglianza e dei diritti del sangue. Furono gli illuministi a far conoscere al mondo intero che i diritti dell'uomo per definirsi tali devono essere eguali per tutti, senza alcun tipo di distinzione di nascita, ceto, nazionalità, religione, genere, colore della pelle; universali, cioè validi ovunque; inalienabili e imprescrittibili di fronte a ogni forma di istituzione politica o religiosa. Ed è proprio ponendo l'accento sul principio di inalienabilità che la cultura illuministica – vero laboratorio della modernità – trasformò radicalmente gli sparsi e di fatto inoffensivi riferimenti ai diritti soggettivi nello stato di natura in un linguaggio politico capace di avviare l'emancipazione dell'uomo. Spaziando dall'Italia di Filangieri e Beccaria alla Francia di Voltaire, Rousseau e Diderot, dalla Scozia di Hume, Ferguson e Smith alla Germania di Lessing, Goethe e Schiller, sino alle colonie americane di Franklin e Jefferson, Vincenzo Ferrone affronta un tema di storiografia civile che si inserisce nel grande dibattito odierno sul nesso problematico tra diritti umani e autonomia dei mercati, tra politica e giustizia, diritti dell'individuo e diritti delle comunità, dispotismo degli Stati e delle religioni e libertà di coscienza.

The Declaration of Independence was not only its first paragraph, that is the political manifesto of the right of revolution – the right of independence. The Declaration was also its second paragraph, that is the political manifesto of the Enlightenment constitutional project of the natural rights of man – the project which unified American and European Enlightenment in the Atlantic space with an Enlightenment Natural Rights of Man Talk. What happened to that project in the American constitutional process? To rewrite the history of the origins of the United States tracking down in the institutional and public debate that Enlightenment language, that constitutional project and that cultural heritage means to tell a passionate and glorious struggle that was lost. It means to talk – together with about the true and republican revolution, that of the right of independence – about a missed revolution – that of the natural rights of man.
