«Medio evo del diritto», come titolo di un’opera di storia, può forse saper di astrattezza e ha bisogno di essere giustificato: proprio sul terreno storico, dove le astrattezze non allignano. Non è facile. Medio evo – si dice – è soltanto un concetto della nostra mente, qualcosa dunque di relativo, e destinato a sparire quando le ragioni che lo generarono si saranno consumate nella nostra coscienza. E diritto – si dice anche – è una cosa che i giuristi cercano ancora di definire. Queste, le basi dell’astrattezza del titolo, se pur è da ammettere che un’astrattezza abbia basi. Tuttavia, se vogliamo esser sinceri, confessiamo pure che quelle astrattezze sono state per secoli gli spiragli attraverso i quali lo spirito umano è riuscito a intravedere qualcosa di concreto: altrimenti, non avremmo potuto nemmeno pensare quelle astrattezze. E a questi spiragli vorremmo che altri occhi si accostassero ancora e ficcasser lo viso: ma, perché essi non temano di veder delle nebbie, noi vogliamo dir subito, adoprando parole tutte dell’uso comune, che codesto qualcosa di concreto è semplicemente una «storia del diritto», che ha come sua epoca il «medio evo», come teatro d’azione l’«Italia». Ma qui ci nasce l’obbligo di dar conto di ciascuna di queste affermazioni, e proprio per paura dell’uso comune che le ha consacrate, e spesso fraintese. Le ha fraintese in modo particolarmente grave di fronte al primo e fondamentale problema che quella storia pone, e cioè quello delle fonti del diritto. Nella storia bimillenaria della Chiesa l’alleanza tra la teologia e il diritto canonico ha permesso di attuare riforme importanti e incisive. La straordinaria flessibilità della scienza canonistica medioevale e moderna ne è stata la condizione primaria. Ma da un certo momento in poi le due discipline non hanno più marciato in sintonia. L’assenza di collaborazione tra loro è una delle cause che hanno frenato la recezione dei decreti conciliari. Questo problema si ripropone, in modo urgente, dopo che papa Francesco ha valorizzato la prospettiva sinodale nella Chiesa e, nel contempo, stimolato un rinnovamento epistemologico delle scienze sacre. Tenendo conto di questo duplice livello di riforma, il volume si propone di risalire alle cause della separazione della teologia dal diritto canonico, individuando nel Codice del 1917 una svolta determinante non solo per la scienza canonistica, ma anche per le discipline teologiche e la concezione della Chiesa. Una riflessione storico-critica sui presupposti lontani della codificazione canonica e sulla frammentazione attuale della teologia può servire a superare gli ostacoli epistemologici che impediscono una rinnovata alleanza tra teologi e canonisti e a progettare un comune cambio di paradigma. Al tempo stesso, l’esperienza canonistica può integrare efficacemente la riflessione teologica, richiamando la necessità che le riforme nella Chiesa si attuino attraverso strutture sinodali e si consolidino mediante un lavoro di mediazione dottrinale e istituzionale.

The formation or developing process of the Ivonian work (i.e. Decretum, Panormia, Tripartita) is an emblematic example for the proper textual-history of Medieval Canonical Collections before the late 12th century. The recent studies concerning the Pre-Gratian canon law collections show well how the earlier meaning of “canonical collection” differs from its classical meaning. The fundamental intention was to summarize the whole of canon law which – as “ius sacrum” – served the daily life of the Church and was useful in every field of the ecclesiastical activity. The textual families of Ivo’s canonical work and the textual variants of these families demonstrate well this intention. In this present volume are described several 11th-12th century manuscripts and fragments of the Ivonian canon law collection. The precise paleographical, codicological and textual-critical analysis which was done by the author has improved the considerations on the step by step textual-development. These new results have shown in new light Ivo’s compiling work.
