Ogni opera dedicata alla teoria dell’argomentazione giuridica presuppone sempre, anche quando non consapevolmente esplicitata, una teoria giuridica particolare. Teoria istituzionale e ragionamento giuridico tenta di sviluppare una nuova versione dell’istituzionalismo e, sulla base di ciò, mira a delineare un modello di argomentazione giudiziaria consapevolmente ancorato nelle strutture sviluppate in sede teorico-generale. Partendo dall’istituto quale concetto che si compone di quelle particolari proprietà che sono i princìpi giuridici, e intendendo questi ultimi, poi, quale punto di condensazione dei valori, Teoria istituzionale e ragionamento giuridico intende sottolineare il ruolo che istituti, valori e princìpi hanno sia nella fase di produzione legislativa delle norme sia nella fase della loro applicazione giudiziaria.Leonardo Di Carlo, (San Giovanni Rotondo, 1972), dopo aver compiuto studi di filosofia e di diritto, ha perfezionato la sua attività di ricerca presso l’Istituto Italiano per gli Studi Filosofici di Napoli, la Scuola Internazionale di Alti Studi di Modena e le Università di Colonia, Francoforte sul Meno e Kiel. Attualmente è Ricercatore in Filosofia del diritto presso l’Università di Foggia. Si è occupato di teorie idealistiche del diritto, di diritti fondamentali e di teoria del discorso.

Stefano Bartolini argues that, despite the growth of a large theoretical literature about institutions and institutionalism over the last thirty years, the specific nature of political institutions has been relatively neglected. Political institutions have been subsumed into the broader problems of the emergence, persistence, change and functions of all types of institutions. The author defines political institutions strictly as norms and rules of 'conferral', to be distinguished from norms/rules of 'conduct' and of 'recognition'. They are those norms and rules that empower rulers, set limits to the capacity to ensure behavioural compliance, and define the proper means for achieving such compliance. This book draws logical and empirical consequences from this understanding, to distinguish different types of norms/rules, and to specify the peculiarities of those norms/rules that are 'political'. The book will appeal to researchers of political institutions in comparative politics, and in political science and political sociology more broadly.

In consequence of an increased interest in problems relating to human action, normative concepts have been much discussed by philosophers and logicians in the past twenty years. Deontic logic, which deals with the normative use of language and such normative concepts as obligation, prohibition and permission, has become one of the most intensively cultivated areas of formal logic. Important investigations have been carried out which have shed considerable light on various aspects of the normative phenomenon and a great number of different systems of deontic logic have been developed. This progressive proliferation of deontic logics not only shows the great interest of logicians in normative discourse, but also reflects a basic perplexity: the lack of suitable criteria of adequacy for the interpretation of deontic calculi and hence difficulty in decid ing which of the systems provides the best reconstruction of the underlying normative concepts and can therefore be applied with the most fruitful results. This difficulty is so great that some authors have even expressed doubts about the practical usefulness of deontic logic. One of the sources of this perplexity lies in the absence of a well established pre-analytical basis for formal studies. It is sometimes even uncertain what the intuitive notions are that deontic logicians intend to reconstruct. In talking about obligations, prohibitions and permissions, they usually have in mind moral norms. But the choice of moral norm as an explicandum for the construction of a logic of norms has several disadvantages.
