"From the fourteenth to the eighteenth centuries the armies of the Ottoman empire brought terror, in the name of Islam, to much of the Christian world. Intermittently, but relentlessly, the Sultans' forces raided, then conquered the Danube Valley as far as Budapest and beyond. Their inexorable progress westward eventually brought them into conflict with the dynastic confederation created in central and eastern Europe by the Austrian Habsburgs. Repeatedly faced with virtual annihilation by superior Muslim forces, the ruling powers in Vienna fought to mobilise the minds as well as the military resources of their subjects in order to save both their faith and their soil. The propaganda developed by both government and church, particularly the Roman Catholic variant, created, then reinforced many of the negative stereotypes of Muslims that are still familiar to Europeans today. Gradually, after the middle of the seventeenth century, Habsburg rulers and officials came to see that its political and military survival required solid information about the Muslim foe that prejudiced ideas did not supply. In Terror and Toleration, Paula Sutter Fichtner traces the story of this change of heart and mind in government and intellectual circles throughout the Habsburg empire. This episode shows, she argues, that it is possible to form and disseminate negative views of an enemy for political and strategic reasons, yet be able to reconfigure those views as circumstance and necessity dictates. Civil war and conflict within countries is the most prevalent threat to peace and security in the opening decades of the twenty-first century. A pivotal factor in the escalation of tensions to open conflict is the role of elites in exacerbating tensions along identity lines by giving the ideological justification, moral reasoning, and call to violence. Between Terror and Tolerance examines the varied roles of religious leaders in societies deeply divided by ethnic, racial, or religious conflict. The chapters in this book explore cases when religious leaders have justified or catalyzed violence along identity lines, and other instances when religious elites have played a critical role in easing tensions or even laying the foundation for peace and reconciliation. This volume features thematic chapters on the linkages between religion, nationalism, and intolerance, transnational intra-faith conflict in the Shi’a-Sunni divide, and country case studies of societal divisions or conflicts in Egypt, Israel and Palestine, Kashmir, Lebanon, Nigeria, Northern Ireland, Sri Lanka, Sudan, and Tajikistan. Political disputes over toleration are endemic, while toleration as a political value seems opposed to those of civic equality, neutrality and sometimes democracy. Toleration in Political Conflict sets out to understand toleration as both politically awkward and indispensable. The book exposes the incoherence of Rawlsian reasonable pluralist justifications of toleration, and shows that toleration cannot be fully reconciled with liberal political values. While raison d'état concerns very often overshadow debates over toleration, these debates – for example about terrorism – need not be framed as a conflict between toleration and security. Framing them in this way tends to obscure objectionable behaviour by tolerators themselves, and their reliance on asymmetric power. Glen Newey concludes by sketching a picture of politics as dependent on free speech which, he argues, is entailed by the demands of free association. That in turn suggests that questions of toleration are inescapable within the conditions of politics itself.

The war on terror cannot be truly understood without investigating the legitimacy of modernity, the challenge that religion presents to modernization, the inescapable conflicts attending the emergence and expansion of modernity, and the post-colonial predicament from which Islamist reaction arises. Richard Dien Winfield illuminates the war on terror in light of these issues, presenting an anti-foundationalist justification of the rationality and freedom of modernity, while assessing how religion can stand in opposition to modernity and why Islam has been a privileged vehicle of anti-modern religious revolt. Winfield shows that the privatization that religion must undergo to be compatible with modern freedom involves no capitulation to relativism, but rather is a theological imperative on which the truth of religion depends. Exposing the limits of any purely secular modernization of Islam, Winfield shows how Islam can draw upon its core tradition to repudiate the oppression of Islamist reaction and become at home in the modern world.

Every State has an obligation to prevent terrorist attacks emanating from its territory. This proposition stems from various multilateral agreements and UN Security Council resolutions. This study exhaustively addresses the scope of this obligation of prevention and the legal consequences flowing from its violation, so as to provide greater clarity on governments' counterterrorism duties and to enhance State accountability for preventable wrongs. It defines the contents and contours of the obligation while placing critical emphasis on the mechanics of State responsibility. Whether obscured by new technologies like the Internet, the sophisticated cellular structure of some terrorist organisations or convoluted political realities, the level of governmental involvement in terrorist activities is no longer readily discernible in every instance. Furthermore, the prospect of governments waging surrogate warfare through proxies also poses intractable challenges to the mechanism of attribution in the context of State responsibility. This monograph sets out the shortcomings of the extant scheme of State responsibility while identifying a paradigm shift towards more indirect modes of accountability under international law, a trend corroborated by recent State and institutional practice. Drawing on varied legal and theoretical influences, the study devises and prescriptively argues for the implementation of a strict liability-inspired model grounded in the logic of indirect responsibility with a view to enhancing State compliance with counterterrorism obligations. This shifts the policy focus squarely to prevention, while promoting multilateralism and transnational cooperation. Ultimately, the legal and policy sensibilities underlying the book converge into a new theory of prevention in counterterrorism contexts.
