European Contract Law unification projects have recently advanced from the Draft Common Frame of Reference (2009) to a European Commission proposal for an optional Common European Sales Law (2011) which is to facilitate cross-border marketing. This book investigates for the first time how CESL and DCFR rules would interact with various aspects of domestic law, represented by English and German law. Nineteen chapters, co-authored by British and German scholars, examine such interface issues for eg pre-contractual relationships, notions of contract, formation, interpretation, and remedies, extending to non-discrimination, third parties, transfers or rights, aspects of property law, and collective proceedings. They go beyond a critical analysis of CESL and DCFR rules by demonstrating where and how CESL rules would interact with neighbouring areas of English and German law before English and German courts, how domestic traditions might influence the application, which aspects might motivate sellers and buyers to choose or reject CESL, and which might serve as model for national legislators. The findings are summarized in the final two chapters.

Standards-based accountability has become a central feature of the public education system in each state and is a theme of national discussions about how achievement for all students can be improved and achievement gaps narrowed. Questions remain, however, about the implementation of standards and accountability systems and about whether their potential benefits have been fully realized. Each of the 50 states has adopted its own set of standards, and though there is overlap among them, there is also wide variation in the ways states have devised and implemented their systems. This variety may have both advantages and disadvantages, but it nevertheless raises a fundamental question: Is the establishment of common K-12 academic standards, which states could voluntarily adopt, the logical next step for standards-based reform? The goal of this book is not to answer the policy question of whether or not common standards would be a good idea. Rather, the book provides an objective look at the available evidence regarding the ways in which standards are currently functioning, the strategies that might be used to pursue common standards, and the issues that doing so might present.

Measuring government effectiveness is essential to ensuring accountability, as is an informed public that is willing and able to hold elected officials and policy-makers accountable. There are various forms of measurement, including against prior experience or compared to some ideal. In Yardstick Competition among Governments, Pierre Salmon argues that a more effective and insightful approach is to use common measures across a variety of countries, state, or other relevant political and economic districts. This facilitates and enables citizens comparing policy outputs in their own jurisdictions with those of others. An advantage of this approach is that it reduces information asymmetries between citizens and public officials, decreasing the costs of monitoring by the former of the latter -along the lines of principal-agent theory. These comparisons can have an effect on citizens' support to incumbents and, as a consequence, also on governments' decisions. By increasing transparency, comparisons by common yardsticks can decrease the influence of interest groups and increase the focus on broader concerns, whether economic growth or others. Salmon takes up complicating factors such as federalism and other forms of multi-level governance, where responsibility can become difficult to disentangle and accountability a challenge. Salmon also highlights the importance of publics with heterogeneous preferences, including variations in how voters interpret their roles, functions, or tasks. This results in the coexistence within the same electorate of different types of voting behavior, not all of them forward-looking. In turn, when incumbents face such heterogeneity, they can treat the response to their decisions as an aggregate non-strategic relation between comparative performance and expected electoral support. Combining theoretical, methodological, and empirical research, Salmon demonstrates how yardstick competition among governments, a consequence of the possibility that citizens look across borders, is a very significant, systemic dimension of governance both at the local and at the national levels.

English Abstract: In recent years, court systems in the U.S. and abroad have begun to adopt objective, empirically based methods for determining the need for court resources. This methodology, called workload assessment or weighted caseload, provides an empirical basis to measure judicial work and assess how many judges are needed to handle the work in a particular jurisdiction, how judicial resources can be equitably allocated, and how much work any particular judge should handle. This article provides a general introduction to the basic elements and applications of the methodology in both nascent and transitional democracies, assesses the pros and cons of alternative methods (Delphi vs. time study) for developing case weighting systems, and profiles the usage of case weighting systems by three court systems (Bosnia and Herzegovina, the Republic of Serbia, and Kosovo). The article concludes with a set of practical findings regarding the development and implementation of a case weighting system.Spanish Abstract: En los últimos años, los sistemas judiciales de EEUU y otros países han comenzado a adoptar métodos objetivos y empíricos para determinar la necesidad de recursos judiciales. Esta metodología, llamada evaluación de la carga de trabajo o carga de trabajo ponderada, proporciona una base empírica para medir el trabajo judicial y valorar cuántos jueces hacen falta para desempeñar el trabajo en una jurisdicción concreta, cómo se pueden administrar los recursos judiciales de forma equitativa y cuánto trabajo debería encomendarse a cada juez. Este artículo proporciona una introducción general a los elementos y aplicaciones básicos de la metodología tanto en democracias nacientes como en aquellas transicionales, sopesa los pro y los contra que presentan métodos alternativos (Delphi, estudio del tiempo) para desarrollar sistemas de ponderación del trabajo, y realiza un perfil del uso de sistemas de ponderación del trabajo en tres sistemas judicales (Bosnia y Herzegovina, la República de Serbia y Kosovo). El artículo concluye con un cúmulo de hallazgos prácticos referidos al desarrollo e implementación de un sistema de ponderación del trabajo.
