This paper builds a dynamic theory of secessions, conflictual or peaceful, analyzing the forward looking interaction between groups in a country. The proposed framework allows us to jointly address several key stylized facts on secession, and generates several novel predictions. We find that if a group out of power is small enough, then the group in power can always maintain peace with an acceptable offer of surplus sharing for every period, while when there is a mismatch between the relative size and the relative surplus contribution of the minority group, conflict followed by secession can occur. Accepted peaceful secession is predicted for large groups of similar prosperity, and higher patience is associated to a higher chance of secession. We formulate as a result a number of policy recommendations on various dimensions of federalism and other institutions.

This book analyses cases of incomplete secession after separatist wars and what this means for relations between central governments and de facto states. The work explores the interplay between violence and power by examining the micro-dynamics inherent in the process of escalation between separatists and central governments. These dynamics affect not only the security interactions between these entities, but also the character of political and governance relations that are built in the aftermath of secessionist war. The book provides comprehensive analyses of the evolution of post-conflict relations between the Republic of Moldova and Transnistria and between Georgia and South Ossetia and Abkhazia. Beyond these empirical and conceptual examples, the book contributes to a key debate in International Relations that addresses the relationship between democratisation, nationalism and violence, and its applicability to the study of escalation in the post-Soviet space. Constitutionalising Secession proceeds from the question, 'What, if anything, does the law have to say about a secession crisis?' But rather than approaching secession through the optic of political or nationalist institutional accommodation, this book focuses on the underpinnings to a constitutional order as a law-making community, underpinnings laid bare by secession pressures. Relying on the corrosive effects of secession, it explores the deep structure of a constitutional order and the motive forces creating and sustaining that order. A core idea is that the normativity of law is best understood, through a constitutional optic, as an integrative, associative force. Constitutionalising Secession critically analyses conceptions of constitutional order implicit in the leading models of secession, and takes as a leading case-study the judicial and legislative response to secession in Canada. The book therefore develops a concept of constitutionalism and law-making - 'associative constitutionalism' - to describe their deep structure as a continuing, integrative process of association. This model of a dynamic process of value formation can address both the association and the disassociation of constitutional systems.

Contesting Spain? The Dynamics of Nationalist Movements in Catalonia and the Basque Country offers an exploration of the dynamics behind contemporary shifts in the orientation of nationalist parties and movements with reference to Catalonia and the Basque country in Spain. The chapters were originally papers presented at a workshop held at the Barcelona Centre for International Affairs (CIDOB) in September 2014 as part of a research project on ‘The Dynamics of Nationalist Evolution in Contemporary Spain’, whose purpose was to gain a better understanding of why regionally-based nationalist movements have experienced shifting relationships with the Spanish state over time, in some periods appearing content with accommodation between central and regional government and at other times pushing to go beyond autonomist demands to seek sovereignty or even attain full independence. The volume is one of the first to focus comparatively on the rise of pro-sovereignty politics in mainstream nationalist parties, whose evolution has also featured more traditional impulses towards territorial accommodation within the wider state. Using the exceptionally rich laboratory provided by Spain, the book explores the dynamics behind shifts in the orientation of nationalist parties and movements once they have established themselves as electorally successful at regional level. Secession is a detachment of a territory from an existing state with the aim of creating a new state on the detached territory. Secession is usually an outcome of the political mobilization of a population on the territory to be detached and, as a political phenomenon, is a subject of study in the social sciences. Its impact on inter-state relations is a subject of study in international relations. But secession is also subject to regulation both in the constitutional law of sovereign states and in international law. Following a spate of secessions in the early 1990s, legal scholars have proposed a variety of ways to regulate the international responses to attempts at secessions. Moreover, since the 1980s normative justification of secession has been subject to an intense debate among political theorists and moral philosophers. This research companion has the following three complementary aims. First, to offer an overview of the current theoretical approaches to secession in the social sciences, international relations, legal theory, political theory and applied ethics. Second, to outline the current practice of international recognition of secession and current domestic and international laws which regulate secession. Third, to offer an account of major secessionist movements - past and present - from a comparative perspective. In their accounts of past secessions and current secessionist movements, the contributors to this volume focus on the following four components: the nature and source of secessionist grievances, the ideologies and techniques of secessionist mobilization, the responses of the host state or majority parties in the host state, and the international response to attempts at secession. This provides a basis for identification of at least some common patterns in the otherwise highly varied processes of secession.

How do states prevent the recognition of territories that have unilaterally declared independence? At a time when the issue of secession is becoming increasingly significant on the world stage, this is the first book to consider this crucial question. Analysing the efforts of the governments of Serbia, Georgia, and Cyprus to prevent the international recognition of Kosovo, South Ossetia, Abkhazia, and northern Cyprus the work draws on in depth interviews with a number of leading policy makers to explain how each of the countries has designed, developed, and implemented its counter secession strategies. After explaining how the principle of the territorial integrity of states has tended to take precedence over the right of self-determination, it examines the range of ways countries facing a separatist threat can prevent recognition by other states and considers the increasingly important role played by international and regional organisations, especially the United Nations, in the recognition process. Additionally, it shows how forms of legitimisation or acknowledgement are also central elements of any counter-recognition process, and why steps to prevent secessionist entities from participating in major sporting and cultural bodies are given so much attention. Finally, it questions the effects of these counter recognition efforts on attempts to solve these territorial conflicts. Drawing on history, politics, and international law this book is the first and only comprehensive account of this increasingly important field of foreign policy.
