The most generic challenge faced by many international courts is the level of obedience by their member states. The EACJ is not an island to this common reflection. Essentially, international courts are influential only when their decisions are easily complied with and executed by member states. If not, as with the case of the EACJ, then, such an international court will always be on the brink of being toothless and ineffective. At the end of each reference, the EACJ delivers a judgment. It also issues interim orders carrying a status similar to that of a court judgment. Member States as well as the Council are bound to implement EACJ judgments without delay. But there are no established mechanisms to ensure compliance in the event that a state refuses to implement a decision against it. Since 2005 the EACJ has dealt with more than 190 matters. What is intriguing in those judgments is tracking the extent to which they have been met with compliance. Member States have not been sanctioned when they have failed to comply with the EACJ's decisions. It is a matter of fact and a matter of principle that the nature of EACJ judgments is declaratory, and this tends to attract noncompliance. The best the Court can offer is to declare violations of the law, give orders for injunctive relief, and award costs to the successful applicants. The costs order depends on the nature of the case. Public interest cases do not attract costs orders.

Using the phenomenon of public interest litigation (PIL) as the primary focus of analysis, this book explores the manner in which the judicial branch of government in the three East African states of Kenya, Tanzania and Uganda has engaged with questions traditionally off-limits to adjudication and court-based resolution. It is rooted in an incisive investigation of the history of politics and governance in the sub-region, accompanied by an extensive repertoire of judicial decisions. It also provides a critical and informative account of the manner in which courts of law have engaged with State power in a bid to alternatively deliver or subvert justice to the socially marginalized and the politically victimized. The focus of the book is on judicial struggles over sexual and gender-based discrimination, social justice and poverty, and the adjudication of presidential elections. The performance of international courts has traditionally been judged against criteria of compliance and effectiveness. Whilst these are clearly desirable objectives for litigants before Africa's international courts, this book shows that we must look beyond these criteria to fully appreciate the impact of these courts. This book shows how litigants use their participation in international litigation to achieve other objectives: to amplify political disputes with their governments, to build their movement, to educate the public about their cause, and to challenge the status quo. Chapters in this collection show how these courts act as coordination points for opposition political parties to name and shame dominant parties for violation of their organizational rights. Others demonstrate how Africa's international courts serve as transitional justice mechanisms in which truth telling about ongoing conflict and authoritarian governance receives significant attention. This attention serves as a platform to galvanize resistance against continued authoritarian rule, especially from outside the conflict countries. Ultimately, the book shows that these courts must be judged against new and broader criteria, and understood as increasingly important venues for waging political, social, environmental, and legal struggles.
