The institutional development of American legislatures, beginning with the first colonial assembly of 1619, has been marked by continuity as well as change. Peverill Squire draws upon a wealth of primary sources to document this institutional history. Beginning with the ways in which colonial assemblies followed the precedents of British institutions, Squire traces the fundamental ways they evolved to become distinct. He next charts the formation of the first state legislatures and the Constitutional Congress, describes the creation of territorial and new state legislatures, and examines the institutionalization of state legislatures in the nineteenth century and their professionalization since 1900. With his conclusion, Squire discusses the historical trajectory of American legislatures and suggests how they might further develop over the coming decades. Excerpt from The History of Legislative Methods in the Period: Before 1825 It is the purpose of this work to trace the growth of the committee systems in the lawmaking bodies of the colonies and states from about 1750 to 1790, and in the federal House of Representatives from the beginning to 1825. During these years the committee form of organization was so firmly established that it has become the distinguishing feature of the American legislature. In view of this fact it seemed to be worth while to put in accessible form the more important steps in that early development. Matters of procedure are touched upon only in so far as they throw light on the main theme. In the processes of legislation it is difficult to separate completely the operations of the regular committees from the activities of the party caucus, and the following chapters discuss both types of organization, the formal, provided for by the rules, and the informal, supplied by the political party. An attempt is made to show how the colonial legislatures were directed by party leaders, how the caucus and the executive influenced the work of the federal House, and also how certain arrangements made primarily to facilitate legislation have affected some of the larger aspects of constitutional history. This study was undertaken at the suggestion of Professor Allen Johnson, of Yale University, and the material in Chapters I to VII, inclusive, with the exception of a part of Chapter II, was worked out in the form of a doctoral dissertation under his direction in 1913. The Right of Instruction and Representation in American Legislatures, 1778 to 1900 provides a comprehensive analysis of the role constituent instructions played in American politics for more than a hundred years after its founding. Constituent instructions were more widely issued than previously thought, and members of state legislatures and Congress were more likely to obey them than political scientists and historians have assumed. Peverill Squire expands our understanding of constituent instructions beyond a handful of high-profile cases, through analyses of two unique data sets: one examining more than 5,000 actionable communications (instructions and requests) sent to state legislators by constituents through town meetings, mass meetings, and local representative bodies; the other examines more than 6,600 actionable communications directed by state legislatures to their state’s congressional delegations. He draws the data, examples, and quotes almost entirely from original sources, including government documents such as legislative journals, session laws, town and county records, and newspaper stories, as well as diaries, memoirs, and other contemporary sources. Squire also includes instructions to and from Confederate state legislatures in both data sets. In every respect, the Confederate state legislatures mirrored the legislatures that preceded and followed them.

How can we explain the evolution of legislatures in Western Europe? This book analyses ninety procedural reforms which restructured control over the plenary agenda and committee power in Britain, France, Sweden, and Germany between 1866 and 2015. Legislatures evolve towards one of two procedural ideal types: talking (where governments control the agenda) or working legislatures (with powerful committees). All else being equal, legislators' demand for mega-seats on legislative committees triggers the evolution of working legislatures. If, however, legislators fail to centralize agenda control in response to anti-system obstruction, legislative procedures break down. Rather than a decline of legislatures, talking legislatures accordingly indicate the resilience of legislative democracy. In conclusion, the book shows the causal nexus between procedural reforms and (legislative) democracy.
