Excerpt from The Habitual Criminals Bill, and Reformatories for Adults In the same clause occurs the same measure as in the previous, viz., that the offender after such third conviction if found under circumstances of suspicion, may be sentenced to 12 months' imprisonment by two Justices or a Stipendiary Magistrate. As I have before said, I do not like throwing the responsibility of a. 12 months' sentence upon a Court of hardly sufficient weight to bear it. And here I think another alteration is needful. On the cumulative principle, successive punishments ought to increase in severity, and when a man has had seven years penal servitude, it seems useless to return him to the common Gaol. I should like therefore to add that he may be committed on summary conviction before two Justices to imprisonment not exceeding three months; or before Quarter Sessions or Assizes, to penal servitude not exceeding seven years. Before leaving this Clause you must pardon my again saying that I believe it will turn out to be the most important measure for the Repression of Habitual crime that has ever been passed. Excerpt from Juvenile Offenders I have had occasion to point out publicly from time to time that one of the formidable problems confronting civilised communities at the close of the present century is the problem of habitual crime. It is perfectly well known to every serious student of criminal questions, both at home and abroad, that the proportion of habitual criminals in the criminal population is steadily on the increase and was never so high as it is now. In almost every official document dealing with penal administration this unsatisfactory state of things is both admitted and deplored. In France, Germany, and Italy the proportion of old offenders who come before the criminal courts is constantly growing, while in Eng land matters are just as bad. This is made perfectly clear by the report of the Committee on the Iden tification of Habitual Criminals. From a table compiled for the use of that committee it appeared that in Lancashire, the West Riding of Yorkshire, and Staffordshire about 70 per cent. Of the prisoners tried were known to have been previously convicted in Liverpool, Birmingham, and Bradford, 79 per cent. The Charles Lindbergh “crime of the century” in 1935 first brought lie detectors to the public’s attention. Since then, they have factored into the Anita Hill–Clarence Thomas sexual harassment controversy, the Oklahoma City and Atlanta Olympics bombings, and one of the most infamous criminal cases in modern memory: the O. His theory of the “born” criminal dominated European and American thinking about the causes of criminal behavior during the late nineteenth century and the early twentieth.
