This book provides detailed analyses of systems that have been established to provide reparations to victims of genocide, crimes against humanity and war crimes, and the way in which these systems have worked and are working in practice. Many of these systems are described and assessed for the first time in an academic publication. The publication draws upon a groundbreaking Conference organised by the Clemens Nathan Research Centre (CNRC) and REDRESS at the Peace Palace in The Hague, with the support of the Dutch Carnegie Foundation. Both CNRC and REDRESS had become very concerned about the extreme difficulty encountered by most victims of serious international crimes in attempting to access effective and enforceable remedies and reparation for harm suffered. In discussions between the Conference organisers and Judges and officials of the International Criminal Court, it became ever more apparent that there was a great need for frank and open exchanges on the question of effective reparation, between the representatives of victims, of NGOs and IGOs, and other experts. It was clear to all that the many current initiatives of governments and regional and international institutions to afford reparations to victims of genocide, crimes against humanity and war crimes could benefit greatly by taking into full account the wide and varied practice that had been built up over several decades. In particular, the Hague Conference sought to consider in detail the long experience of the Conference on Jewish Material Claims against Germany (the Claims Conference) in respect of Holocaust restitution programmes, as well as the practice of truth commissions, arbitral proceedings and a variety of national processes to identify common trends, best practices and lessons. This book thus explores the actions of governments, as well as of national and international courts and commissions in applying, processing, implementing and enforcing a variety of reparations schemes and awards. Crucially, it considers the entire complex of issues from the perspective of the beneficiaries - survivors and their communities - and from the perspective of the policy-makers and implementers tasked with resolving technical and procedural challenges in bringing to fruition adequate, effective and meaningful reparations in the context of mass victimisation.

Gender oppression has been a feature of war and conflict throughout human history, yet until fairly recently, little attention was devoted to addressing the consequences of violence and discrimination experienced by women in post-conflict states. Thankfully, that is changing. Today, in a variety of post-conflict settings--the former Yugoslavia, Afghanistan, Colombia, Northern Ireland --international advocates for women's rights have focused bringing issues of sexual violence, discrimination and exclusion into peace-making processes. In On the Frontlines, Fionnuala Ní Aoláin, Dina Francesca Haynes, and Naomi Cahn consider such policies in a range of cases and assess the extent to which they have had success in improving women's lives. They argue that there has been too little success, and that this is in part a product of a focus on schematic policies like straightforward political incorporation rather than a broader and deeper attempt to alter the cultures and societies that are at the root of much of the violence and exclusions experienced by women. They contend that this broader approach would not just benefit women, however. Gender mainstreaming and increased gender equality has a direct correlation with state stability and functions to preclude further conflict. If we are to have any success in stabilizing failing states, gender needs to move to fore of our efforts. With this in mind, they examine the efforts of transnational organizations, states and civil society in multiple jurisdictions to place gender at the forefront of all post-conflict processes. In Guatemala, it was called the "trial of the century": the 2013 prosecution of former de facto head of state (1982-1983) General José Efraín Ríos Montt and his intelligence chief, General José Mauricio Rodríguez Sánchez, on charges of genocide and crimes against humanity against the Maya-Ixil people. Ríos Montt's seventeen-month reign was one of the bloodiest periods in Guatemala's history, with "scorched earth" massacres, the destruction of hundreds of Maya communities, and militarized resettlement of Mayas into "model villages." Ríos Montt was convicted on all charges. Ten days later, a higher court vacated the verdict on dubious procedural grounds. Nevertheless, Guatemala's genocide trial, held in the domestic courts in the country where the crimes were committed, was precedent-setting. In this volume, Guatemalan and international scholars rigorously explore the complexities of the Guatemala experience and reflect upon the case's implications for understanding and prosecuting the category of genocide more broadly. Topics include: the nexus of racism and counterinsurgency in explaining Guatemala's genocide; the politics of Maya collective memory; the intersections of gender, sexuality, and ethnicity in genocide; the decades-long interconnections of national and transnational justice processes that brought the case to trial; and the limits and contributions of tribunal justice.
