This book explores the relationship between the Responsibility to Protect (R2P) and the International Criminal Court (ICC), challenging the assumption that they are always mutually reinforcing or complementary, and examining instead the many tensions which arise between the immediate imperative of saving lives, and the more long-term prospect of punishing perpetrators and preventing future conflicts through deterrence. Around the world, audiences in the mid-1990s watched the mass atrocities unfolding in Rwanda and Srebrenica in horror and disbelief. Emerging from these disasters came an international commitment to safeguard and protect vulnerable communities, as laid out in the R2P principle, and an international responsibility to punish perpetrators, with the establishment of the ICC. The book provides context-independent proposals for resolving contradictions between the two principles, suggesting that focusing on timing and sequencing in invoking international R2P and ICC actions could facilitate the easing of tensions. Drawing on examples from Uganda, Kenya, and Darfur, the book applies International Relations concepts and theories in order to deepen our understanding of international responses to mass atrocities. Ultimately the book concludes that a 'Protection First, Justice Later' sequence approach is necessary for managing the tension and facilitating more effective and consistent international responses. This book makes an important contribution to discussions and debates surrounding international responses to genocide and mass atrocities. This book seeks to reimagine why and how to confront mass atrocities in world politics. Drawing on Hannah Arendt’s conception of evil, it interprets and understands mass atrocities as ‘evil’ in an ‘Arendtian’ sense, that is, as crimes against human plurality and, thus, crimes against humanity itself. This understanding of mass atrocities paves the way for reframing responses to mass atrocities as attempts to confront evil. In doing so, the book focuses on military intervention under the banner of the Responsibility to Protect (R2P) and judicial intervention by the International Criminal Court (ICC) and reframes them as tools to protect human plurality from evil. Furthermore, the book looks at the place and the role of R2P and the ICC in the changing landscape of world order. It argues that the protection of humanity from evil can serve as a legitimate Grundnorm (basic norm) around which a global constitutional order in an inherently pluralistic world can be constructed.

Millions of people, particularly in Africa, face daily the prospect of death at the hands of state or state-linked forces. Although officially both the United Nations and the African Union have adopted "Responsibility to Protect" (R2P) principles, atrocities continue. The tenets of R2P, recently cited in a UN Outcomes Document, make it clear that states have a primary responsibility to protect their citizens from genocide, war crimes, ethnic cleansing, and crimes against humanity. When states cannot—or will not—protect their citizens, however, the international community must step into the breach. East Asia, until recently the scene of widespread blood-letting, has achieved relative peace. A region that at the height of the Cold War had accounted for around eighty percent of the world's mass atrocities has experienced such a decline in violence that by 2015 it accounted for less than five percent. This book explains East Asia's 'other' miracle and asks whether it is merely a temporary blip in the historical cycle or the dawning of a new, and more peaceful, era for the region. It argues that the decline of mass atrocities in East Asia resulted from four interconnected factors: the consolidation of states and emergence of responsible sovereigns; the prioritization of economic development through trade; the development of norms and habits of multilateralism, and transformations in the practice of power politics. Particular attention is paid to North Korea and Myanmar, countries whose experience has bucked regional trends largely because these states have not succeeded in consolidating themselves to the point where they no longer depend on violence to survive. Although the region faces several significant future challenges, this book argues that the much reduced incidence of mass atrocities in East Asia is likely to be sustained into the foreseeable future.
