In The Language of Fraud Cases, Roger Shuy follows the now well-established format of his previous volumes on language and law. He discusses here eight cases that he himself has consulted on, and that illustrate how linguistics can help to solve the various problems that arise in trying to define fraudulent language in the context of law. He examines speech events, schemas, agendas, speech acts, conversational strategies, as well as smaller language units such as sentences, phrases, words, and sounds, and discusses how these can play a major role in deciding fraud cases. The cases chosen for this volume hinge on recorded language evidence, making them particularly relevant for linguistic analysis, and include cases of government contracts, EPA regulations, foreign corrupt business practices, trade secrets, money laundering, securities trading, art theft, and price fixing. Through his examination of these cases, Shuy demonstrates the significant contribution of linguistic analytical methodology to the understanding of language evidence and its success in revealing willful uses of fraudulent language to achieve financial gain.

Exploring the interplay of love, money and threat in romance fraud, this Element reveals how language is used to persuade, manipulate, and threaten without causing alarm. It provides the first empirical examination of criminal interactions-in-action that exposes and tracks the grooming process and manipulation techniques from first contact with the fraudster, to the transition between romance and finance, and requests for money and intimate images, before morphing into explicit threats and acts of sextortion. Through the use of a range of interactional methodologies and real romance fraud messages, a new type of criminality in the form of 'romance fraud enabled sextortion' is revealed. The insights contained in this work have clear implications for future directions of academic exploration and practitioner efforts to protect the public. This title is also available as Open Access on Cambridge Core.

Excerpt from The Law of Fraud: And the Procedure Pertaining to the Redress Thereof Tempting as was the history of so venerable a branch of law, the limits which the author assigned for his work precluded all unnecessary departures from his design of presenting an orderly View of the existing Law of Fraud. Indeed, it was soon found that to attempt to treat the subject properly, in all its features, within the limits of a single volume of convenient size, would be vain; and the result was that the criminal law of fraud was left altogether untouched, and the statutory law concerning fraud on creditors and purchasers presented simply in the language of the Legislatures, without note or com ment. Whatever may have been the author's original desire, the eliminations suggested are not now regretted. The criminal and statutory branches of the subject have been often and ably treated by others. Besides, criminal law would hardly be looked for in a book treating of the civil jurisprudence of fraud; and, as to the statutory law concerning fraud on creditors and purchasers, each State of the Union, with a few exceptions, has a code of its own, interpreted by independent tribunals, and eu forced by distinct and diverse penalties and modes of procedure.
